This letter will confirm that I have reviewed the Second Amendment to
Agreement Concerning Easements and Restrictions ("Second Amendment") sent to my
office via email on January 30, 2006 relating to the Albertville Crossing plat and have
determined that the Second Amendment meets the requirements of paragraph 6.J. and
3.E. of the Developer's Agreement with the City of Albertville for Albertville Crossings
requiring the Developer to establish an access and drainage and utility easement
agreement over the platted lots. Please note that the requirement of paragraph 3.E.
requiring the Developer to provide the City with a drainage easement over the pond on
Outlot B remains unfulfilled. I have forwarded a drainage easement over Outlot B to the
Developer for signature.
It is my understanding that you will have the Second Amendment executed by the
various property owners and will record it at the Wright County Recorder's Office.
Please let me know when the agreement has been recorded. Thank you.
