The City of Albertville has the responsibility to administer the Minnesota Wetland Conservation Act
(WCA). As part of that responsibility, the City of Albertville must address wetland impacts and
violations of the Act that may occur. In early summer 2003, a site visit was conducted to review the
onsite wetland mitigation area. At the time of that site visit, a breech in the berm between the wetland and
the adjacent stormwater pond was observed. Your office was contacted on July 17, 2003 regarding the
breech and the need to repair it. Several site visits to the Albertville Crossings Phase II wetland
mitigation site occurred after that time and the breech had still not been repaired. On October 8, 2003 you
were contacted directly concerning the breech in the berm area and you stated that a contractor would be
sent out there to repair the breech within the next few days.
To date the breech has still not been repaired and therefore is a violation of the WCA as unauthorized fill.
This letter is serving notice that emergency repairs of the breech within the berm need to be completed.
You have 30 days to complete the emergency repair from the date of this letter. Additionally, final
grading and any other repairs that may be necessary along with seeding of the berm with an appropriate
native seed mix will need to be completed by May 31st 2004. If these conditions are not complied with, a
Cease and Desist order will be issued for the site (Chapter 8420.0290).
