BACKGROUND
Oppidan Investment Company has submitted the final plat of "Albertville Crossing
Second Addition." The final plat consists of four (4) lots located west and southwest of
Albertville Crossing.
The original approval for the preliminary plat on April 5, 1999 included four (4) lots, a
Comprehensive Plan amendment and rezoning to B-2, Limited Business District. The
preliminary plat approved on April 15, 2002 included the parcels now designated
Albertville Crossing Second Addition as Outlots A and C. Due to a consolidation of lots
in the final plat, rezoning will be required for clarification purposes for one lot designated
Lot 2, Block 1 Albertville Crossing Second Addition.

EXECUTIVE SUMMARY
The City Council approved the rezoning and preliminary plat of Albertville Crossing on
April 5, 1999 subject to the requirement of adequate buffering and landscaping between
commercial and residential uses. A copy of the preliminary plat is attached to the draft
Findings of Fact and Decision for the final plat as Exhibit B-1. The City Council
approved the preliminary and final plat of Outlots A and C, the subject of Albertville
Crossing Second Addition, on April 15, 2002. A copy of the preliminary and final plat is
attached to the draft Findings of Fact and Decision for the final plat as Exhibit B-2. The
final plat has been reviewed based upon the applicable Zoning and Subdivision
Ordinance requirements.
The requested approval of the final plat requires that the City Council consider the
applications in relation to established Zoning and Subdivision Ordinance review criteria.
The decision to approve or deny the final plat is viewed as a policy decision to be made
by the City Council. Should the Council find the submitted plans acceptable, it is
recommended that the following conditions be imposed.
1. The final plat shall be subject to review and approval of the City Engineer pertaining
to the final street design, grading and drainage plans.
2. The final plat shall clearly indicate a statement dedicating all easements as follows:
"Easements for the installation and maintenance of utilities and drainage facilities
are reserved over, under and along the strips marked "utility easements."'
3. The final plat shall contain a certification be a registered surveyor in the form
required by Minnesota Statute Section 505.03, as amended from time to time.
4. The final plat shall clearly indicate the name and address of the surveyor preparing
the lot.
5. The final plat shall be subject to review and approval of the City Engineer pertaining
to the final street design, grading and drainage plans.
6. Legal description to be reviewed and approved by City Attorney.
7. The applicant shall file for rezoning of Lot 2 Block 1 Albertville Crossing Second
Addition to either B-2, Limited Business District or B-3, Highway Commercial District.
8. Amend Development Agreement to include final plat of Albertville Crossing Second
Addition.
9. Any other conditions as set forth by the City Council, City staff, City Consultants or
other agency responsible for review of this application.
DISCUSSION
The final plat has been found by our review to be in substantial compliance with the
preliminary plat. The preliminary plat approved April 5, 1999 indicated four (4) lots east
of CSAH 19 west of LaCentre Frontage Avenue. Two of such lots were zoned B-2,
Limited Business District and two of such lots were zoned B-3, Highway Commercial
District. The final plat shows a consolidation and reduction to three (3) lots. The City
may require the applicant to amend the preliminary plat to be consistent with the final
plat. Such action would require a public hearing. A rezoning of Lot 2, Block 1
Albertville Crossing Second Addition is necessary due to the referenced lot
consolidation.
In addition, the final plat includes a lot east of LaCentre Frontage Avenue designated
Outlot C on the Preliminary Plat approved on April 15, 2002.
RECOMMENDATION
To assist the City Council in formulating its recommendation, a draft Findings of Fact
and Decision document has been prepared outlining the suggested conditions of
Albertville Crossing Final Plat

approval for this project. The decision to approve or deny the requested final plat of
Albertville Crossings Second Addition is viewed as a policy decision to be made by the
City Council. The Executive Summary of this report outlines recommended conditions
of approval should the decisions be made in favor of the developer.
ACTIONS REQUESTED
1. A motion to approve, deny or conditionally approve the final plat of Albertville
Crossings Second Addition pursuant to the conditions of the attached Findings of
Fact and Decision.
