Elk River, MN 55330 Dear Jim: RE: Albertville, Minnesota 2002 Albertville Crossing - Phase 2 SEH No. A-ALBEV 0208.01 14 In August 2002, Twin Pines Excavating, the grading contractor for the above referenced project, pumped untreated storm water from the site detention pond into the City storm sewer, which eventually discharges into a storm water pond located just east of Lachman Avenue. Discharging untreated storm water into the City's detention pond has damaged that pond by prematurely filling it with silt and debris. This is in violation of your Developers Agreement with the City of Albertville. Per the Developer's Agreement, you are required to clean out the pond to it's preconstruction condition within the next 30 days. If the work is not completed within 30 days, the City will complete the work and deduct the cost from the project surety. Please call me if you have any questions. Si ely, Peter J.
