RE: Albertville Zoning Compliance Letter for Especially for Children Day Care

Dear Ms. Willing:
On behalf of the City of Albertville and the Especially for Children Day Care located at
5600 LaCenter Avenue, Suites 112 -114, 1 am drafting a letter of zoning compliance for the
purposes of allowing Especially for Children Day Care to receive their business license.
Especially for Children Day Care is locating in the Albertville Crossings Shopping Center.
This site is zoned B-2 which allows for day care as a conditional use within that zoning
district. Especially for Children Day Care has filed application for conditional use and
submitted all plans related to the proposed operation of day care consistent with Albertville
zoning.
On December 10, 2002, the Albertville Planning Commission conducted a public hearing
and considered all comments related to the conditional use application. On December 16,
2002, the Albertville City Council met and voted to approve the day care conditional use
permit with the following conditions:
The applicant is to post a non-parking/no loading area along the curb adjacent to
the west side of the outdoor playground.
2. A striped pedestrian crossing connecting the southwest parking area to the curb in
front of the day care facility shall be installed.
3. Outdoor playground area shall have a combination of soft ground covering and hard
surface.

4. The applicant must obtain a fence permit. A six foot fence is required around the
playground.
5. Appropriate screening for the site as determined by the Albertville City Council.
6. The applicant is to submit an illumaire schedule, location, summary and cut sheet
showing the light fixtures.
7. Lighting is to be recessed so bulbs are not visible and have a 90 degree cutoff.
8. The structure and operation shall be in compliance with State of Minnesota
Department of Human Services regulations and shall be licensed accordingly.
9. Upon issuance of any day care facility conditional use, the City reserves the right
at any time and all reasonable hours, with or without notice, to inspect the premises
in which the operation is being conducted to insure compliance with the provisions
of Section 1700 or any conditions conditionally imposed.
The latest site inspection reveals that the applicant is moving toward full compliance with
the conditions of the conditional use permit approval. With this letter the Department of
Human Services should be advised that the Especially for Children Day Care located at
5600 LaCenter Avenue, Suites 112-114, is in compliance with the Albertville zoning
regulations and has fulfilled their obligations under their conditional use permit approval.
