We were directed to investigate whether the Albertville Crossings Shopping Center was in conformance with the requirements related to the screening of the back of the shopping center area. In our review, we discovered that the Albertville Crossings Shopping Center preliminary plat and site plan was approved in March and April of 2002. The attached site plan, landscape plan was approved as part of the development contract related to the shopping center. I conducted a site inspection of the site and determined that the proposed landscape plan has been implemented consistent with the approved landscape plan for the shopping center. The types and varieties of plants are consistent with what has been approved. I did note that two of the Black Hills spruce located on the eastern side of the outlot were dead and should be replaced. Aside from this issue, it appears that the applicant has complied with the requirements of the landscape plan. The trash enclosures approved as part of the shopping center were screened walls rather than full enclosures. This development occurred in 2002 prior to the current regulations which were adopted in November 2003, which spelled out the more specific requirements for trash enclosures. As a result, the current trash enclosures for the Albertville Crossings Shopping Center are a legal, non -conforming design. I contacted Gary Janish regarding the complaints that we received. He has forwarded a letter dated August 27, 2004 indicating that they will make an attempt to address all issues related to site cleanliness and unkempt order. It is not their intent to generate complaints. In my direct discussion with Mr. Janish, he is reluctant to spend more money on the site but would rather address this as a management issue and try to keep everything in good order. In this regard, he indicated that the dumpsters would be placed in close proximity to the screen walls and no garbage would be allowed beyond the individual dumpsters. Aside from this response, it does not appear that we are in a position to require additional improvements to this site in that the applicant is compliant with both the site and building design that was approved in 2002. We may investigate this again if any additional improvements to the site are requested by the applicant. At such time, it will trigger a more detailed review of the site and specific comments to the appearance of the back of the building will be raised. I further understand that these complaints came from the townhouse residents and they were referring to the back of the main retail building. In light of these complaints, I spoke with our garbage removal company, cleaning service, and Senior Property Manager and wanted to share the following with you. Dick's Sanitation has been the garbage removal company for the main retail building for the past hvo years. I spoke with Todd Anderson, our sales representative and he reported that the drivers keep excellent records and if anything is found to be out of the ordinary they would notify him immediately, anc he in turn would contact me. Dick's is on site four (4) days a week; twice for garbage removal, once for cardboard pick-up and once for recycling pick-up. As a result of these frequent pick-ups, they are very familiar with the site and would notice if something was amiss. Todd spoke with the route driver earlier this week, and after reviewing his notes, confirmed that the dumpsters have always been within their enclosures when he has been on site for pick-ups. Commercial Contract Cleaning cleans all of our properties. They are responsible for the exterior cleaning of each site and are at Albertville Crossing three (3) nights per week. One of their primary responsibilities it to ensure the back of each building on site is kept tidy. They pick-up and remove any miscellaneous trash, sweep the area — including the dumpster enclosures, and ensure that all dumpsters are placed back in their enclosures before they leave each night. As with Dick's Sanitation, if anything out of the ordinary is found they notify me immediately. As of late, they have had nothing to report and also confirmed that the dumpsters on site were kept within their respective enclosures. I also spoke with Elizabeth Janisch, our Senior Property Manager in regards to these complaints. Elizabeth conducts monthly center inspections of each site and except for some miscellaneous trash or extra cardboard; she has not reported this area being dirty and/or unkempt. Alan, you may rest assured that HJ Development takes great pride in the appearance, both front and back, of all of our centers. We hold our vendors to the highest standards and expect that our properties look their best at all times. I am confident that Albertville Crossing is, and will continue to be, well maintained.
