AGREEMENT TO ALLOW HAULING ACROSS Sa,T" STREET
WHMEAS, Cascade U Land Company, LLC ("Developee") desires to
haul dirt from its Albertville Crossings plat south of 576' Street to a location on its
property north of 57'h Street; and
WHEREAS, the Developer has requested that the City close 57"' Street to
allow for easier crossing of 57'h Street by Developer's trucks when hauling flirt,
and
WHEREAS, the City of Albertville ("City") has aged to allow the
closure of 5701 Street for a limited period of time for such hauling, provided
Developer ages to the fallowing terms:
NOW, THEREFORE, the City and Developer agree as follows:
1. The City shall allow the closure of 57'" Street at: a time and location to be
determined by the City Engineer for the purpose of Developer hauling 10,000
to 20,000 cubic yards of sail across 57"' Street. The closure of 57`h Street shall
not exceed 5 business days, and shalt be reopened for weekend traffic.
2. Developer may haul dirt across 57'h Street from 7 a.m. to 7 p.m. during the
closure.
3. Developer shall promptly repair, to the City's smtisfaction, all damage. that
occurs to 57'h Strreetand the accompanying curbs, gutters, and sidewalks as
may be readily identified by the City Engineer.
4, Developer shall provide the City with a letter of credit or other security in the
amount. of $10,000.00 (Developer can use the same letter of credit as wil I be
provided under the Albertville Crossings Second Addition Developer's
Agreement) as security for the repair of any damage which occurs to 57thi
Street, the accompanying curbs, gutters, and sidewalks and other public
improvements damaged by Developer's hauling activities.
5. Developer shall pay the City a, fee of$1,000 as compensation for anticipated
damage to the subgrade of 57" Street. Developer acknowledges thist
Developer's hauling activities will likcly cause damage to the subgradc, and
also acknowledges that such damage which may occur to the subgradc will
likely not manifest itself in a readily -observable form for several years.

6. Developer shall not haul soil across 57'h Street until. i) it has constructed an
earthen "bridge" on top of the street in a manner aeoeptable to the City
EAST cer; and ii) it has coordinated the closure of 57 Street with the City's
fire department.
