2002-04-29 Petition to Install StreetCITY OF ALBERTVILLE WRIGHT COUNTY, MINNESOTA PETITION TO INSTALL STREET, SANITARY SEWER, WATER, CURB, GUTTER, STORM SEWER AND GRADING IMPROVEMENTS AND REQUEST TO ASSESS COSTS TO ABUTTING LANDOWNER The undersigned landowners (referred to collectively as "Landowners"), all of whom own property in City of Albertville, Wright County, Minnesota, hereby petition the City of Albertville (" City") to install street, sanitary sewer, municipal water, curb gutter, storm sewer, grading and turning and passing lane improvements to serve those properties shown on the attached Exhibit A. Landowners further request that 100% of the cost of the improvements attributable to Landowners' property (including _q _% of the turning and passing lane improvements), including construction costs, cost of easements, engineering fees, bonding fees and expenses, attorney's fees, and other costs incurred by the City relating to the improvements described above be assessed against Landowners' property, in the estimated amount of $�385; ©3/ (consisting of construction costs, contingency, engineer's fees, financing costs and attorney's fees). Further, Landowners hereby waive any objection to being assessed for the cost of the project against the above described property in the amount of $ 3 8 S, 0 8Y, 3Z Landowners hereby waive their right of appeal to the District Court herein, pursuant to Minnesota Statute 429.081. Landowners waive their right to appeal the assessment to District Court for any amounts in excess of $ 3�; : pgy 3/ which are the direct result of additional requests made by the Landowners after the date of this petition. Further, it is understood by and between the Landowners and the City that the construction improvements will benefit the property. Landowners agree that the benefit to the property will be greater than the cost of construction of the improvements described above. Landowners hereby represent that they have received a copy of the bids reflecting the estimated construction costs of said improvements and that Landowners have been fully informed as to the estimated cost of the improvements. Further, the spreading of the assessment against the above described property shall be in the best interest of the City. The assessment shall be against the properties owned by Landowners.
