2001-08-06 Prelim Plat AppCITY OF ALBERTVILLE City Council Findings of Fact & Decision Preliminary Plat Applicant's Name: John Darkenwald. Darkenwald Real Estate — Albertville Business Park Request: Mr. John Darkenwald has submitted an application for preliminary plat for property located to the west of the Outlets at Albertville site and on the north side of I- 94. The request is to plat three building sites with related right-of-way and outlots to include ponding and wetland areas. Planning Commission Meeting Date: July 25, 2001 City Council Meeting Date: August 6, 2001 Findings of Fact: Based on review of the application and evidence received the City Council now makes the following findings of fact and decision: The legal description of the subject property is attached as Exhibit A. The Planning Report to the City Council dated August 1, 2001 is incorporated herein. Decision: Based on the foregoing considerations and applicable ordinances, the preliminary plat of Albertville Business Park is approved based on the most current plans and information received to date, subject to the following conditions: 1. The preliminary plat shall not proceed to final plat unless the roadway projects move forward concurrently. 2. The grading, drainage and wetland information is subject to the review and approval of the City Engineer. 3. Each lot is subject to site plan review for the individual users identified in the future. 4. Park dedication shall be paid based on the rates in effect at the time of preliminary plat. 5. B-3 zoning regulations shall provide the basis for site development and permitted land uses under the PUD zoning. Adopted by the Albertville City Council this 6th day of August 2001.
