Chairman Zachman asKed to amend his answer to Marion Conwel l~s
question in paragraph 5 of the Publ ic Hearing, FranKl in Outdoor
Advertising of May 6, 1991, minutes to say "The old ordinance requires
three se tbacKs and tha t ~ s why we need the var i ance." Zachman made a
motion to approve the minutes as amended. Vetsch seconded the motion.

The minutes of the Town Board meeting of May 6, 1991, were amended on
Page 2, paragraph 3, 1 ine 18, to change the word examine to
"execute," put a period after site plan, and delete the rest of the
sen tence. Page 3, paragraph 3 was amended to add af ter the first
period, "Lazer made a motion to adopt the Findings of Fact for Randy
Pe 11 e tier Cond it j ona 1 Use Perm it. Zachman seconded the mot i on all
voted aye." Lines 8 and 9 are amended to add af ter Perm it, "as
presented and as amended," and delete the rest of the sentence. The
last paragraph of Page 4 was amended to add "for Schandosy~s
Industrial ParK." Zachman asKed to have "Scherber said he did raise
the diKe," deleted from Page 5, paragraph 2. Zachman made a motion to
approve the m i nu tes as amended. Ve tsch seconded the mot i on. All
voted aye.
Treasurer Mary Beth Carlson reported a general fund balance on today~s
da te of $32,355.90. The sav i ngs accoun t balance as of today is
\ $612.26. Carlson explained that the savings account is an account set
up to earn interest on interest. Carlson said we no longer have a

computer printout available each month. Linda Houghton has offered
the op t i on of buy i ng time from her compu ter to Keep the records
curren t. Pi ch 1 er made a mot i on to au thor i ze Mary Be th Car 1 son to
checK on what is needed and to arrange the purchase of time on Linda
Houghton~s computer. Zachman seconded the motion. All voted aye.
There was a brief discussion on the township budget and spending.
Zachman, Berning and Carlson agreed to meet to looK for ways to cut
township spending and stay within budget.
Pichler made a motion to approve the Orders to be Issued including one
to J&B, not on the 1 ist, but which is basically a J&B escrow transfer
of funds. Vetsch seconded the mot i on. Zachman asKed if the cracK
filler is done. Berning-"yes." Discussion on sweeping followed.
Zachman called for a vote on the motion. All voted aye.
Bu i 1 ding Off i cia 1 Kev i n Meal house repor ted two perm its were issued -
one to replace a fail ing septic system and one for a new home. Vetsch
questioned the daycare permit. Mea1house reported no permit had been
issued yet. The board indicated they wish to talK about fee schedules
with Mealhouse later, as Vetsch and Zachman met earl ier and had some
proposals ready.
KEVIN AND JONI SCHMIDT. CONDITIONAL USE PERMIT. Attorney Goodrich went
through the proposed Conditional Use Permit for Kevin and Joni Schmidt
to opera te a Home Ex tended Bus i ness. Kev i n Schm i dt was asKed if he
had any commen ts. He had noth i ng to add. Ve tsch made a mot i on to
grant the Conditional Use Permit as presented. Van Hall seconded the
mot i on. Zachman quest i oned the three year term. Goodr i ch sai d the
appl icants agreed to this term. Zachman called for a vote. All voted
aye.
RANDY PELLETIER Conditional Use Permit was previously acted on and was
brought for the chairman to sign.
RELEASE LETTERS OF CREDIT - Norman Dehmer - RaatiKKa reported he had
inspected the roads after weight restrictions were removed and that
with the exception of the administrative costs, the letter of credit
for Norman Dehmer shou 1 d be re 1 eased. Pi ch 1 er made a mot i on to
release Norman Dehmer~s letter of cr'edi t as soon as the appl icab1e
bills are paid. Vetsch seconded the motion. Berning read the costs
for Dehmer. All voted aye.
Ro11ie Lindenfe1ser Roads have been irlspected. Zachman made a
motion to release the letter of credit for Roll ie Lindenfelser as soon
as app 1 i cabl e bill s have been pa i d. Van Ha 11 seconded the mot i on.

Denn i s Fehn Cond it i ona 1 Use Perm it - Raa t i KKa repor ted the Fehn CUP
rece i ved pre 1 i m i nary approva 1 and has been rev i sed as requested. A
letter of credit is needed from Fehn.

HALSEY AVENUE - Award Bid - The assessment roll has been adopted for
Improvement Project 91-1 so the bid can now be awarded. Vetsch made a
motion to award the bid for Halsey Avenue in the amount of $89,623.75
to Buffalo Bituminous. Pichler seconded the motion. All voted aye.

FOSTER HILLS - RaatiKKa reported he had spoKen to Steve Scharber and
that Scharber will taKe care of the erosion problem in Foster Hills,
even though the letter of credit has expired. He will seed or sod.
PUBLIC HEARING. 50TH and MacIver-Improvement hearing is set for May
30, 1991, at 7:30 p.m. Albertville will have to approve for the
project to go. RaatiKKa will set up a meeting.
DUST CONTROL - Both Zachman and Berning have received calls - one a
health issue. Pichler asKed if residents are willing to pay, or can
they apply the product themselves? Allowing residents to apply would
present 1 iabi1 ity issues. Pichler suggested a notice in the Crow River
News indicating dust control applications are available on an as
needed basis, with payment to the township in advance. Wayne would
have to have the road graded and ready. Zachman had ca 11 ed one
company for a pr i ce. Van Hall fe 1 tat 1 east one other quote was
needed. Berning will prepare a notice for the Crow River News.
BARTHEL ROLLING HILLS - Vetsch made a motion to instruct the clerK to
notify Barthel in what respects they are in default in Rolling Hills
and that they must notify the township by June 15, 1991, of their'
intentions, or the township will do the worK using the money in
escrow, comencing such action on June 17. Pichler seconded the
motion. All voted aye.
EULL SITE PLAN APPROVAL - Bern i ng repor ted the zon i ng quest i on had
been clarified - that the area in question was zoned I-I. Joe Eu11
spoKe on behalf of Eu11 Manufacturing. They had reviewed RaatiKKa~s
letter and made the requested changes. They would 1 iKe to remove the
screening off the site plan on the east side. This is across from the
ceme tary. Pi ch 1 er agreed and Zachman sta ted as long as the area is
Kept neat, it should not be a problem. RaatiKKa said the new
landscaping ordinance is not yet in effect. E1 iminating the screening
on CR 19 would reduce the escrow $945. Jeff Zachman felt it could be
detracting at the time of a burial. Eu11 stated that they shut down
and close the doors at that time. Roll ie Eull questioned substituting
another tree for Pine or Spruce and whether the evergreens need to be
as close as shown. He was tol d 15 foclt spac i ng wou 1 d be amp 1 e. On
the west side the pine and spruce were getting into the gravel &
crushed rocK. RaatiKKa suggested pulling it in five feet so that it
is 5 and 10. After agreement on trees and spacing, Eu11 requested new
figures on the escrow accoun t wh i ch Raa t i KKa figured for him - from
$6,300, down to $5,175. Zachman sa i d the townsh i p needs to be as
consistent as possible when approving site plans. Pichler made a
mot i on to approve the site plan for Eu 11 Manufac tur i ng as presen ted
and as amended. Vetsch seconded the motion. All voted aye.
OMANN~S update - Glen Daleiden requested. Goodrich said the board met
and agreed to issue a new 10-year term CUP subject to settlement
terms, which could now be made public and a coPy could be provided.
The board is not under obl igation to issue a new CUP, but if they do

putting a new bagger on the machine which is supposed to be better for
polution. It is built away from the regular mixer. Daleiden reported

could not see. Goodrich requested that a note be written about such

asKed if the tra i 1 er house on the proper ty was approved through

Environment impact study? The board will get copies of the extensive
stipulated agreement. Pichler felt it was not unreasonable to asK for
so i 1 samp 1 es before go i ng into another agreemen t. Pi ch 1 er : We need
to Know if the PCA requ ires th i s as part of 1 i censi ng and set up a
hearing on the CUP.
REQUEST FOR "CHILDREN AT PLAY" SIGN Berning reported that
representatives from Crow River Acres were here tonight to request a
sign on Parnell and two other streets in the development, but they
left due to length of the meeting. They are also trying to get a
petition on 1 ighting. Zachman questioned how much good a sign does.
Pichler felt the sheriff should go through more often. Zachman said
it is really a problem. There is a Home Association in the area.
Zachman wondered if they could help. No action was taKen.
AGREEMENTS FOR ROAD RESTRICTIONS - Albert Zachman said that next year
no perm its will be issued to use roads when they are posted. The
county does not bend one inch on posted roads and neither should the
township.
TOM KACHEVAS~ LETTER - Wa ter dra i naCle -The board has de 1 t with th i s
problem in Crow River Acres several times and it is still a problem.
Pichler asKed if curbing was a possibility. RaatiKKa said plenty of
grading is needed on the road. Zachman said the culverts have almost
been closed. Zachman and Van Hall will looK at it.
Eldred Heinen - Countryview Acres Water. Mr. Heinen showed the board
pictures of his yard at 5800 Naughtor Avenue, at the south end of
Coun tryv i ew Acres. The bacK side is under wa ter. Gerard Zachman
added his agreement to the problem. G. Zachman indicated he would
1 iKe to maKe sure that RaatiKKa~s calculations were correct. Zachman
said in an October 24 letter it was agreed he would taKe 11.13 acres
of wa ter and he will accep t no more. He fur ther sta ted Lenz was
assigned 9.8 acres. Zachman says the problem must be settled. G.
Zachman i nd i ca ted Scherber had worKed on the diKe today, bu t tha tit
is not high enough. RaatiKKa is setting up a meeting for the morning
with Scherber. He i nen has 1-1/2 acres and bu i 1 t his house in 1988.
He says he has no yard--just a swamp and it is ge t t i ng close to his
septic system.
PLANNING AND ZONING COMMISSION VACANCY - ClerK Berning will advertise
the vacancy.
CHAMBER OF COMMERCE. A letter was received concerning membership in
the newly formed St Michael-Albertville Chamber of Commerce. Pichler
agreed to a t tend as a represen ta t i ve of FranKfor t if they wish to
participate. Pichler made a motion to participate for a one-year

( trial. Van Hall seconded the motion. All voted aye. It will be
determined if the dues of $50 are required from governmental agencies.
Van Hall made a motion to appoint Pichler to represent the board on
the Chamber of Commerce. Zachman seconded the motion. All voted aye.
MINNEGASCO PERMIT. A permit request was received from Minnegasco to
extend their 1 ine out of Schandosy East into Willow Bend. This was for
information only. Chairman Zachman will sign.
