Dear Mr. Gries:
As discussed today, I was unable to contact Mr. William Goodrich
for a response to your letters of February 1, 1990 and July 2,
1990. Since you need a response for a meeting tomorrow, I have
taken the liberty to respond to your question regarding water
service in Frankfort Township.
Enclosed with this letter, I am submitting a copy of a memorandum
dated March 12, 1990 to the Frankfort Town Board from Mr. Goodrich
and myself. The policies in that memorandum have been adopted by
Frankfort Town Board. The last page of that memorandum requires
that the petitioner pays initially all costs related to
constructing trunk service to the peti tioner ' s property.
Reimbursement to the petitioner will take place as other property
develops. The new connecting property will make reimbursement to
the petitioner proportionately based on the combined number of
units benefitting from the service. The amount of reimbursement
will be an inflated amount based on the cost of construction at the
time the new property connects to the watermain. The Engineering
News Record "ENR" construction cost index shall be used to
determine the amount of inflation in the construction costs.
It should be noted that the cost to M.E.I. in our December 4, 1989
feasibility report is estimated at $113,925 rather than $90,325
since Alternate II was selected by the TownShip. Therefore, under
the current polity it is proposed that the interim cost of $113,925
will be paid back to H.E.I. at the inflated rate based on the ENR
cost index. It should also be noted that the $113,925 cost was
based on the developer of Frankfort Heights constructing the trunk
watermain through his plat prior to the development of Rolling
Hills Estates and the Highway 241 Industrial Park. If this is not
the case, the watermain will be passing through additional
undeveloped property which will increase the cost to H.E.I.

In response to your question if the property east of M.E.I.
develops first would M.E.I. be assessed prior to developing. The
answer is no. Based on Article 1 of the Interim Basis Payment
Policy on the last page of the March 12, 1990 memorandum, the
petitioner initially pays all costs related to constructing trunk
service to the petitioner's property..
I will have Mr. Goodrich respond to your questions concerning
extensions regarding the platting procedure. However, if you have
further questions regarding trunk watermain extensions, please let
me know.

Dear Pete:
I received your letter of January 23, 1991 with enclosures.
I thank you for providing that information. It appears to me that
Tom Berning will not be developing Frankfort Heights in the
immediate future and thus I need a new cost estimate as to the cost
of bringing water from its present location (approximately Marksman
Metals) to Rolling Estates and Highway 241 Industrial Park.
More importantly, the last page of your attachment related to
interim basis payment policy and in particular the reimbursement
of petitioner's interim payment. It appears that the petitioner
who installs the trunk line will be reimbursed by subsequent
developers based on a per unit connection to the trunk line. In
other words, I will need to know the total number of units which
we will need to connect in order to be reimbursed the costs of
extending the line from its present location to the 241 Industrial
Park. I think for these purposes we will have to assume that the
costs will remain as they are at this time without considering any
increased cost based on the ENR. I need to have this information
as soon as possible.

Dear John:
In response to your January 28, 1991 letter, I have made a revised
cost estimate for ex~ending watermain to the proposed plats of
Barthel Rolling Hills and Highway 241 Industrial Park. The added
cost to extend the watermain through the Berning property (proposed
Frankfort Heights) is $107,925. Therefore, if Frankfort Heights
is not developed at this time, the total interim watermain
extension cost that would be the responsibility of Barthel Rolling
Hills and Highway 241 Industrial Park is $221,850.
In response to your questions regarding interim payment, total
payment to the developer installing the watermain would occur when
all the undeveloped land between the developer and the existing
trunk line at T. H. 241 and Marksman Metals was developed. However,
if property to the east of Barthel Rolling Hills and Highway 241
Industrial Park developed, that property would share in the interim
costs of the trunk extension proportionately to the total lots
developed. For example, if M. E. I. develops 100 residential
equivalent units and 100 new residential equivalent units developed
to the east of M.E.I., the newly developed property would have to
pay M.E.I. half the interim cost of extending the trunk or
$110,925. Subsequently, if Frankfort Heights develops, they would
have to pay M. E. I. and the property to the east of M. E. I . the
inflated cost (based on the ENR cost index) of the trunk watermain
running through their property.
