Dear Mr. McCann:
In response to your request that Ordinance No. 2002-18B be waived for nine (9) lots in
the Cedar Creek 5th Addition and as a follow-up to the discussions we had today, the
installation of sump pump discharge lines will be required. However, due to the fact that
the development was not designed with the intention of discharging sump pumps to storm
sewer or bodies of water, the discharge pipe may daylight to an at -grade location to the
side or rear of the property. The grade/ground, at the location the discharge line
daylights, must be contoured such that the sump pump waters are conveyed to the
planned drainage courses of the development.
Also, as requested, please find enclosed the Sump Pump Discharge Requirements detail
sheet showing the house connection requirements and other typical sump pump discharge
requirements. Please note, at locations where sump pump discharge lines do not outlet to
bodies of water, concrete head walls and rip -rap are not required.

John,
I am requesting that the discharge of sump pump ordinance no. 2002-18B be waived for
the following 9 lot/homes of Cedar Creek South 5th.
Block 1 - Lots 1, 4, 5 and 6
Block 2 - Lots 4, 7, 8, 9 and 10 (Lots 7 and 8 are finished homes with completed
yards),
According to the ordinance, residential structures with draintile or storm sewer available
in the rear of the property must discharge sump pumps towards the rear of the property.
There are no draintile or storm sewer structures in the rear of these lots, thus we do not
need to discharge to the rear of the property.
In Block 1 there are two structures that could be utilized for compliance of 3 lots. The
two structures are located between lots 2 - 3 and 8 — 9.
The lots that Woodside agrees could comply with the ordinance are:
Block 1 - Lots 2, 3, 8 and 13 (pond in rear of lot)
As a side note Woodside/Kenco have closed 10 homes in Cedar Creek 5t1' Addition and
not one of these homes has had to comply with the discharge of sump pump ordinance.
Prior to Don Jensen's departure from Woodside this matter was discussed with the then
acting city engineer Peter Carlson and we were lead to believe that older projects did not
have to comply with the new ordinance.
Please respond back to this request in writing.
