Dear Mr. Tomkins,
At the request of Mr. Peter Scherer, the City has been working with Mr. David Hempel in an effort to
release the Letter of Credit held for Towne Lakes 5th Addition, currently in the amount of $56,650.00.
This amount represents 5% of the original estimated cost of the municipal improvements and is held as
security for the second year of the warranty period and to ensure completion of all outstanding items.
Although we have surpassed the second anniversary of the warranty period, the City is unable to release
the Letter of Credit given the number of issues in need of repair and/or completion.
Earlier this month the City reviewed the site for completed punch list items and while progress was
noticed, it was found that a large number of items remain unaddressed. Attached, please find an updated
version of the punchlist originally prepared in March of 2006, titled Punchlist No.4.
Mr. Hempel, representatives of Hennen Construction and the City have discussed the majority of the
items not completed, yet I fear that there may be some confusion regarding expectations of the City for
certain items. For that reason, I offer the following comments pertaining to the outstanding punchlist
items:
Items 2&3
Several PVC c1eanouts serving sump pump discharge draintile extend several feet above
ground and are subject to damage. It will be required that all c1eanouts be adjusted to
final grade and capped with a cast iron cover.
Item No.8
The flared end section trash guard for FES 90A is not properly attached and site erosion
has created a sediment delta at FES 90A's outlet. Proper fastening of the trash guard and
removal of the sediment delta for the wetland will be required.

maintained at all times. Please note only inlets subject to receiving sediment from

Several storm sewer structures have inlet protection currently in place. The City has not
been able to inspect these structures and would like to schedule at time with the
Contractor to do so. At such time, the City will be able to determine if any cleaning or
repairs are required.
This silt fence is in disrepair and not necessary at this time. The silt fence materials need
to be completed removed and disposed of. Cutting the silt fence off at grade is not
acceptable.
Storm sewer structure CB73A needs to be unearthed, the casting needs to be properly
placed and inlet protection needs to be installed.
This structure needs to be sealed to prevent infiltration.
It will be required that these gate valves be adjusted such that they are recessed below the
bituminous pavement.
Upon review of the development agreement, it is believed that the boulevard along the
west side of Linwood Drive is the responsibility of the 5th addition. Restoration of the
boulevard is required at several locations between Laketowne and 68th Street.
Restoration will include the addition of topsoil, grading, and turf establishment.
The street signage shall be installed at this intersection. It appears that the signage has
been damaged and/or removed.
Upon review of the development agreement, it is believed that completion of the "woods"
trail is required as part ofthe 5th addition. Extending the trail to Lakewood Drive will be
required.
The wear course on 69th Street and Linwood Drive shall be constructed to the boundary
line of the 5th Addition. Currently the wear course on both streets stops short of the limits
of the plat.
The ped ramp and sidewalk at the NE corner of 69th and Linwood shall be installed as
shown on the approved development plans.
Items 37 & 40 The boulevards on the west side of Lancaster Way and Linden Street shall be graded and
restored to the boundary lines of the plat.
Items 38 &39 The wear course shall be extended to the boundary lines of plat on both the Lancaster
Way and Lakewood Drive stubs.
Item No. 41 Outlot B, between L3B2 and L1 B3, shall be re-graded and restored. It appears this area
was recently seeded, however, the work has been found unsatisfactory and the area has
since been disturbed by construction activity on the adjacent lot. Please note that the City

intends to mow and maintain this area. The area shall be graded smooth, free of rock,
and hydro seeded or blanketed.
The barricades are damaged and need to be replaced.
The area to be restored requires black dirt, grading, and seeding or sodding.
Throughout the development there are several private utility clean up issues that need to
be addressed. Per discussion with Mr. Hempel, it is understood that CPDC would like
the City to coordinate correction of this work directly with the utility.
Items 45 to 60 All cracked, damaged, or settled curb panels shall be removed and replaced. Sawing and
sealing of cracks will not be permitted.
Items 61 to 63 All cracked, damaged, or settled sidewalk panels shall be removed and replaced.
Items 64 to 68 These items pertain to defects with the trail in the vicinity of the park. While there has
been discussion that the park and the park trail was part of the 3rd addition, it remains the
position of the City that the park and its trails are part of the 5th addition. The defects
identified on the punchlist shall be corrected.
Items 69 & 70 These two items pertain to the settlements found in the mid-block trail of block 4. The
full width of the trail shall be removed and replaced at all damaged and settled locations.

It appears a board, perhaps used during paving operations, was paved over and is causing
pavement failure. The board and failed pavement shall be removed and the trail shall be
patched.
The "woods" trail is experiencing significant longitudinal and fatigue cracking. The
cause of the cracking is believed to be related inadequate structural support at the time of
construction. As an alternative to removing and replacing the trail, as stated on the
punchlist, a I-inch overlay will be permitted.
Upon review of the approved development plans, it has been determined that a
depression behind block 7 existed prior to construction of the trail. No culvert will be
required provided all block 7 homes meet freeboard requirements and the as-constructed
elevation of the trail has not enlarged the ponding area. Elevations ofthe trail at its low
are needed to complete this evaluation.
Upon completion of the "woods" trail extension, grading and restoration of the adjacent
areas will be required.
Bituminous patching around the gate valve at the intersection of Linwood Drive and 68th
Street will be required. The gate valve shall be adjusted to W' below the finish grade of
the adjacent bituminous.
In addition to the outstanding items listed above, several landscaping requirements have not been met.
Enclosed please find a memorandum from the City Planner; dated September 3, 2008, that addresses
these requirements.
