Cedar Creek North Second Addition City Council Findings of Fact & Decision Request: Pilot Land Development ha$ submitted a final plat for 13 lots within Cedar Creek North which was platted as Outlots E and F of Cedar Creek North First Addition. The Jot configuration is consistent with previously approved concepts and the preliminary plat. The utilities and road have been constructed and the grading is complete. This plat completes the road connection from CSAH 37 to 61st Street (connecting to Fairfield). City Council Meeting Date: 7 December 1998 Findings of Fact: Based on review of the application and evidence received the City Council now makes the following findings of filct and decision: 1, The legal description of the subject property is as follows: Outlots E and F, Cedar Creek North. 2. The requirements of Section 2700 (planned unit developments) of the City Zonin9 Ordinance and the platting provisions of the City Subdivision Ordinance have been met. 3. On 10 November 199B the Albertville Planning Commission conducted a public hearing to consider the applicant's request, preceded by a published notice. Upon review of the application and evidence received, the Planning Commission closed the public hearing and recommended that the City Council approve the project. Decision: Based on the foregoing considerations and applicable ordinances, Karston Cove Second Addijiw] has been lIpproved based on the most current plans and information received to date, subject to the following conditions: 1. The developer's agreement for Cedar Creek Planned Unit Development is amended as necessary and approved by the City Attorney. 2. A public hearing is schedUled by the City Council for the vacation of Kadler Avenue and such action is subject to review by the City Planner, Engineer and Attorney. 3. Any outstanding grading, drainage, and/or utility issues shall be subject to review and approval by the City Engineer. 4. Following submittal of plat acreage calculations by the project engineer, park and trail dedication requirements are met as approved by the City Council. 5. One (1) deciduous or coniferous tree is provided per lot. Adopted by the Albertville City Council this 7th day of December 1998.
