Re: City of Albertville; Albertville Plaza Plat.
Dear Ron:
I have received your recent letter regarding your Albertville Plaza, LLC's
("Developer") objection to the signage as approved by the City of Albertville and
incorporated into the Developer's Agreement for the above plat. It is the City's position
that by signing the Developer's Agreement, the Developer will have waived any
objection to the signage as approved by the City and as contained in the Developer's
Agreement.
However, it is the City's understanding that should the Developer deem it
necessary in the future, the Developer may petition the City Council to modify the
signage based upon the needs of a particular tenant or purchaser of one or more of the
lots in the plat. While the City will consider such a request, the granting of that request
shall be in the discretion of the City Council, and if granted would be in the form of a
modification to the PUD and Developer's Agreement. Please let me know if your
understanding is different than that expressed in this letter. Thank you.
