Sidewalks.
Dear Mr. Mooney:
I am writing in reply to your recent question concerning the City of Albertville's
requirement of the installation of sidewalks at the developer's expense. Enclosed is a
copy of the ordinance the City adopted on November 15, 1999 requiring five-foot
concrete sidewalks to be installed where the City's Comprehensive Trail Plan indicates
such trails should be installed. The City's Comprehensive Trail plan shows a trail on the
east side of the property to be platted as the Mooney Addition. At the time the City
Council approved the Mobil site plan, the City Council required as a finding of fact that
the five-foot concrete sidewalk be installed.
As you can see from the date of the ordinance, installation of a trail at the
developer's expense was required by City ordinance prior to the date your plat first came
to the City Council for approval. I do not know why this issue was not identified earlier
in the process. Please contact me if you have any additional questions regarding this
