As many of the letters have pointed out the discussion of storm water pond excavation and the Wetland Conservation Act (WCA) can be debated on a number of points. Needless to say, we at the Wright SWCD coo not share in your opinion that this would not be considered an impact. However, I will not take this opportunity to discuss those issues in this letter. What I do believe is pertinent to the discussion is the fact that the stormwater ponds as shown will be inundated at times, will not have any live storage and most probably will violate the Minnesota Pollution Control Agency's (MPCA's), Non-point Discharge Elimination Systems (NPDES) rules and the City of Albertville's own stormwater ordinances. The ponds as shown on the plan could not have pipe outlets and therefore it will be very difficult to meet pre-development runoff rates. We assume, that these lots will be mostly impervious when fully developed and we would think the City would want to be much more proactive about reducing runoff' and runoff rates to downstream landowners. We have asked for die plans and calculations for these ponds, on at least a couple of occasions and have received nothing as of yet. Also, for your information, we have been contacted on different occasions by downstream landowners, one just recently, with concerns about runoff from this watershed to Otsego Creed and ultimately to the Mississippi river_ A further point I would like to make is that the MPCA's 7050 rules. have the same requirements for sequencing_as the WCA, to impact a water of the state, such as a wetland. We do not believe that avoidance has been properly addressed here, nor were credible alternatives provided. It appears that ponds could be moved out of the wetland which would be much better for the reduction of flows and water quality. We suspect, with the information that has been provided to date, that this plan does not meets their requirements. In conclusion, I would like to request that you reconsider your decision or. behalf of the City or request that it go before the City council for a vote. We have been in contact with Keith Cheeryholmes of the MPCA and would like. to see him included in a TEP panel to re-discuss this project with all the design material available. I look forward to hearing from you with your decision in the near future so we can consider a formal appeal or other actions.
