& Recommendation
Applicant's Name:
Pilot land Development. Cedar Creek South - Third Addition Final Plat
Request: Pilot Land Development has submitted for approva' the Fina' Plat for the Cedar Creek
South - Third Addition to be located within the Cedar Creek Gatf Course Community. The Third
Addition YJOu~d provide 46 single family lots of the total 184 single family lots and 50 town home
lots configured in Cedar Creek North and South. The site is zoned Planned Unit Development
(PUD).
City Council Meeting Date: 15 March 1999
Findings of Fact: Based on review of the application and evidence received. the Planning
Commission now makes the following findings of fact and recommendation:
1. The legal description of the subject property is attached.
2. The Planning ReportJ dated 2 March 1999 (prepared by NACJ Inc.)! is incorporated herein.
3. On 9 March 1999, the Albertville Planning Commission conduded a meeting to consider the
appticanfs request. Upon review of the application and evidence received, the Planning
Commission recommended that the City Council approve the final plat.
Decision: Based on the foregoing considerations and applieabfe ordinancest the applicant's
request for City endorsement of the Cedar Creek South - Third Addition has been approved based
on the most current plans and information received to date, subject to the following conditions:
1. Site grading and drainage is completed to the satisfaction of the City Engineer, as shovm
on the previously approved preliminary plat.
2. One deciduous or coniferous tree is provided per unit or lot in addition to any screening or
other landscaping requirements 'Nhich may be required by the City Council.
3. The applicant must enter into a Development Agreement as a condition of approval of the
final plat The Development Agreement shall stipulate installation of the trail along Karston
Avenue at the developers expense wth credit going tovvard the overall park dedication fees.
location and configuration of the trail shall be shown on the final Grading Plan.
