Re: City of Albertville v. Edina Development Corporation.
Dear Mr. Hegna:
On June 19,2006, the City Council of the City of Albertville granted a variance
from the wetland buffer strip and wetland structure setbacks (as contained in City Code
Section 5000.5B) from 30 feet to 12 feet, consistent with the settlement agreement
entered into between the City of Albertville and Edina Development Corporation dated
May 8, 2006. This variance was granted for the lots shown on the enclosed Exhibit A.
The settlement agreement referenced an Exhibit B which was supposed to list the
lots that the City was to consider for a variance. My copy of the settlement agreement
does not have an Exhibit B attached to it. However, City Staff believes that the list
enclosed with this letter lists all properties which contain wetlands in Albert Villas 1St,
2nd, 3rd, 4tf and 6th Additions. Please examine this list carefully to confIrm that all
propertieS that your client has an interest in have been granted an easement. Under the
settlement agreement, the City must be notifIed within 14 days of your receipt of this
letter if the variance approval is not adequate and Edina Development Corporation
desires to declare the settlement agreement null and void.
