I am writing to you in regards to our meeting on Monday September 22, 2004 fer the wetland mitigation
areas for phases 1 &; 2 in Albertville. As per all the disouasiotlB it appears that moving the mitigation
areas would come with some resistancej therefore we will proceed to make the COn'ections in the original
areas as depicted on the monitoring report. We are proceeding with iliis work in good faith and without
admitting lia.bility now and for future oorrections as we believe it is not our responsibility to police these
properties once they are sold. Four out of the five areas were fined or changed by the homco\'Vnets. We
expect the city will cooperate with us in meeting with the homeowners and explaining the necessity of the
work as promised at our meeting. As we discussedt Edina Development experienced significantly more
resistance to entering 'these: properties from the homeowners than you and other city re:p:resentati yes
reported. We also exp~ot the city ~11I be willing to enforce any violations by homeowners it! the future as
we have 110 legal tights to these pr<>pettics.
I would like the eity to provide a letter tc us that will be a&rCloo upon by the city attorney and Paul
Fabning who represents Edina Development giving us the leial right to use the cities drainage and utility
easements to ruake these corrections tmd spccii}'ing the corrections expected,
We win proceed to schedule this work once we r~eive 'Written authorization from. the city and in
connection with meeting with the homeowners. As we all know we are in a rainy part of the season and
the weather and or wet conditions may prevent U8 from proceeding. As I stated in our meeting we wc:rc
not El'Veln able to proceed with the bike trail due to wet 13ondi.tions. We are optimistic that the weather will
change and these areas will dry up as we are anxious to complete this work and put: this issue behind us.
