GRANT OF PERMANENT EASEMENT
FOR DRAINAGE AND UTILITY PURPOSES
Edina Development Corporation, a Minnesota corporation, hereinafter referred to as "Grantor".
in consideration of good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, does hereby grant unto the City of Albertville, a Milmesota municipal corporation, the
Grantee, hereinafter referred to as the "City", its successors and assigns, forever, a permanent easement
for public drainage and utility purposes over, across, on, under. and throngh the real property situated
within the County of Wright, State of Minnesota, legally described and depicted as the "lVfitigation Area
Easement" on the attached Exhibits A and B (the "Bmdened Property").
Including the rights of the City, its contractors, agents, servants, and assigns, to enter upon said
public easement premises at all reasonable times to construct, reconstrnct, inspect, repair, and maintain
said public drainage and utility systems over, across, on, under. and through the easement premises,
together with the right to grade, level, fill, drain, and excavate the easement premises, and the further
right to remove trees, bushes, undergrowth, and other obstruotions interfering with the location,
construction, and maintenance of said public drainage and utility systems.
The above-named Grantor, its successors and assigns, does covenant with the City, its successors
and assigns, that it is well seized in fee title of the above described easement premises; that it has the
sole right to grant and convey the easement to the City; that there are no unrecorded interests ill the
easement premises; and that it will indemnify and hold the City harmless for any breach of the foregoing

Lakeland Construction Finance (the "Mortgagee") is a mortgagee of all or a portion of the Burdened
Property (as defined in the atta.ched Grant ofPennanent Easement for Drainage and Utility Purposes
(the "Easemenfj) by one or more mortgage(s) recorded in the: office of the County Recorder for Wright
County. Minnesota as Document No(s). 751570. 784298 and 854997 (the "Mortgage(s)"). Mortgagee
hereby consents to and joins in the Basement recorded in the office of the COlUlty Recorder for Wright
County. Minnesota as Document No. ; provided, that the Mortgage(s) shall be and
remain a lien on the Burdened Property until released or satisfied. Mortgagee further hereby agrees to
subordinate, and hereby does subordinate its lien against the above described real property to the lien of
the Easement.

Commencing at the Southeast comer of said Southwest Quarter of the Southeast Quarter; thence
