Dear Ms. Marwitz:
At your request, SEH has reviewed a May 4,2005 letter submitted by Wilkerson & Hegna, P.L.L.P., on
behalf of Edina Development. The letter is in response to a Notice of Default of Developer's Agreement
issued by your office AprilS, 2005, on behalf of the City of Albertville.
SEH personnel participated in a meeting with representatives from the City, Edina Development, and
their contractor, Kuechle Underground, on Tuesday, May 17, 2005. The purpose of the meeting was to
review the status of the construction punchlist and to conduct a field review of County Ditch No.9. The
field review of County Ditch No.9 revealed that some areas of the ditch have been cleaned, but there are
also several areas that remain to be cleaned. Areas remaining to be cleaned were jointly identified by all
parties involved. (See attached sketch.)
Regarding the 3rd Addition, we note the following:
1. The grading for the ditch structure in the vicinity of Kali A venue and Kagan A venue has not been
done.
2. The spare parts kit for the lift station has been delivered to the City.
3. The vent pipe screen at the wet well has been installed.
4. Erosion control fabric has not been removed from the catch basins.
5. Curb and sidewalk replacement and sawing and sealing have not been done.
With regards to the 4th Addition, we note the following:

2. Erosion control fabric has not been removed from the catch basins.
3. The tie band for the culvert apron has been installed.
4. Sedimentation levels in drainage ponds are currently being reviewed by SEH.

For the 6th Addition, we observed the following:
1. The extent of storm sewer cleaning to be done cannot be determined until the erosion control
fabric in the catch basins is removed.
2. Damaged sidewalk and curb has not been replaced.
3. The bituminous trail has not been constructed. Edina Development is currently evaluating
alignment modifications. Seasonal road restrictions were lifted on May 12,2005.
4. Erosion control fabric has not been removed from the catch basins.
5. The existing concrete bridge structure over County Ditch No.9 has not been removed. SEH is
reviewing the structure with Wright County to determine whether the structure serves a purpose
for flood control. If the structure is to remain in place, we recommend it be fenced off to prevent
pedestrian traffic across the structure.
6. Turf restoration of areas disturbed by installation of drain tile lines is being monitored by SEH.
For your information, we have also enclosed an updated construction punchlist indicating which items
have been completed and which items remain unfinished.
