2003-08-149 CC Findings of Fact & Decision4 • 8-19-03 CITY OF ALBERTVILLE City Council Findings of Fact ~ Decision Concept PUD Review Applicant's Name: Boulder Properties and Weber Architects and Planners Request: The applicant is requesting concept stage review of a planned unit development for a commercial development that will include a family restaurant, a convenience store with gas sales and car wash, and a hotel or retail building. Planning Commission Public Hearing Date: August 12, 2003 City Council Meeting Date: August 18, 2003 Findings of Fact: Based on review of the application and evidence received, the City Council now makes the following finding of fact and decision: . A. The Planning Report dated August 7, 2003 prepared by NAC is incorporated herein. B. The Planning Commission Recommendation for the application is incorporated herein. C.. The site and building plans are consistent with the applicable provisions of the Albertville Zoning and Subdivision Ordinance as well as policies of the Comprehensive Plan. Decision: Based on the foregoing considerations and applicable ordinances, the concept stage planned unit development is approved based on the most current plans, dated July 10, 2003, and information received to date, subject to the following conditions being addressed within the PUD development stage submissions: The convenience store with gas sales and car wash is to be built in conjunction with either the hotel or the restaurant. 2. The applicant provides information that illustrates the restaurant site meets the 85 percent impervious surface requirement or the City approves, as a PUD flexibility, the existing impervious surface based on the site and the • outlot to the south. 1 Boulder Properties/Weber Architects and Planners Findings of Fact and Decision • 3. The City Engineer determines that the outlot for dedication as part of the I- 94 freeway is of sufficient size and configuration to accommodate future off ramp planning. 4. The south outlot is properly sized to provide a 30 foot buffer area from the ordinary high water mark of the wetland in accordance with City ordinance. 5. As part of the development stage PUD, the applicant must provide association documents that outline how access easements will be established, how the shared access will be maintained, along with other maintenance of common areas. 6. Access from County Road 37 is approved by Wright County. 7. The applicant's submission of floor plans are parking calculations that are consistent with the City's Zoning Ordinance. 8. The applicant's site plan provides parking dimensions that are consistent with the City requirements. 9. The applicant provides architectural guidelines and colored building elevations that illustrate the architectural stylings of each of the proposed • uses. 10. The site plan must be revised to identify service areas and trash enclosures for each of the uses. All trash enclosures shall be constructed in a manner that is consistent with the architectural exterior finishes of the buildings. 11. The applicant provides a signage plan that illustrates what is intended for the overall site signage. 12. Detailed landscaping plan is to be submitted that includes sufficient landscaping at the perimeters of the site. 13. The applicant provides a detailed lighting plan in conjunction with development stage drawings that illustrate both the type of lighting that is being proposed as well as photometric plan to illustrate foot candle locations on the property. 14. The applicant recognize that the City does not have any definitive plans or knowledge of plans related to a future County Road 37 /Interstate 94 interchange or access. 14.
