Box 9 Albertville, MN 55301 RE: Proposed Factory Outlets -Albertville, Minnesota Dear Gary: ORIGINAL copy, sent via fax VIA FACSIMILE/MAIL You and I have discussed on various occasions our need of assurance concerning sanitary sewer capacity and a state permit for the sanitary sewer crossing the creek adjacent to our property. This letter is written as a formal request to the City of Albertville to guarantee that our required capacity of 35,000 gallons per day be available for our use in early 1997 and also that the state permit to cross the creek with a sewer line be secured by mid- 1996. As you know, without these guarantees we will be forced to suspend our efforts to complete our proposed development. I am sure you can understand our need of these guarantees and why we cannot continue to proceed. The time and money involved in the process are substantial as is our reputation in the industry.
