A decision on the need for. an Environmental Impact Statement (EIS) must now be made in accordance with the standards and procedures of part 4410.1700. An EIS must be ordered if you find that the project has the potential for significant- environmentaleffects: In making this- decision .you must eompare'the impacts. that may be reasonably expected to occur with the following criteria: A:: The type, extent, and reversibility of effects; B. The cumulative potential effects of related or anticipated future projects; C. The extent to which effects can be.mitigated by ongoing public regulatory authorities; and D. The extent to which effects can be anticipated and controlled as a result of other studies undertaken by public agencies or the ~rojeetproposer; or of previous EISs. In making the EIS decision the following procedural requirements must be-met: - 1: The timeframe for the decision depends, upon whether the decision will be made by a single individual or by a council; board, or other body that. meets only periodically. If by an individual; the decisian is to be made within 15 working days of the expiration of the comment period.. If by a body that meets only periodically, the'decsion is to be made at the first meeting held between three and 30 days after the close of the comment period. These timeframes may be extended for the reason cited in item 3 below. 2. You must maintain a written record of some sort, including specific findings: of fact, -which 'supports your decision. The record must include specific responses~to all substantive, timely comments received on theBAW. 3. If you determine that you lack information which is critical to a reasoned decision about the potential for or the significance of any possible environmental. effects, you must proceed in one of two ways.
