David Licht 11 March 1 Albertville - JMJ Shopping Center 163.06 - 96.06 We are in receipt of a copy of Mr. Jim Morse's letter dated 8 March 1996 concerning the "administrative" rezoning of the site of the proposed shopping center. Please be advised that property cannot be administratively zoned. Designation of use as part of a Comprehensive Plan does not convey or change property rights and/or allowed use. Any rezoning must go through the legally defined application, hearing, and enactment process before the Planning Commission and City Council. What appears to be suggested by Mr. Morse is that the City absorb the application fee and processing costs. This would seem to be a policy decision to be determined by the City. Also the timing of the Comprehensive Plan's completion and enactment is far from certain. Whether this can be coordinated with the proposed development is therefore also open to question.
