WETLAND CONSERVATION ACT
RESTORATION ORDER
The Commissioner of Natural Resources hereby orders Rick Lewandowski. Edina Developers and
his/hers/its heirs, successors, and assigns to restore the wetland located in the SW Vi of Section 2. T. 120 N.-
R.24W.(City of Albertville).
Findings of Fact: The wetland has been altered by unauthorized ditching beyond the scope of what
was permitted to enhance the removal of water from the site for residential development. The (continued)
You shall accomplish restoration by doing the following: Restoring the ditches to pre-
construction dimensions as best that can be ascertained by taking the elevations where the ditch enters the

Panel) before work started at its pre-construction location and determining a grade line between these points

This order is issued pursuant to Minn. Stat. 3 1030.2372 and MN Rule part 8420.0290.
On or before 11-1-2000 you must either:
A. restore the wetland in the manner required by this order and obtain a Certificate of
Satisfactory Restoration/Replacement= from the soil and water conservation district;
B. submit an application for approval of a replacement plan to the local government tmit; or
C. apply to the local government unit for an exemption or no-loss determination.
This order will be canceled if you obtain a ACertificate of No-Loss or Exemptiol1= from the local
government unit, or a certificate from the local government unit that replacement has been completed
according to an approved replacement plan. Otherwise, you must restore the wetland in the manner required
by this order. Upon completion of the work required by this order, contact the Wright Soil and Water
Conservation District for a ACertificate of Satisfactory Restoration/Replacement=. Violation of this order
is a misdemeanor.

movement and. as such causes water to enter the County Ditch 9 system more efficiently
via the private ditch as apnosed to being forced across the wetland which provides
hydrology to the wetland and reduces flows to the County Ditch system. Th~
landowner's engineer can't provide pre-alteration survey shots of the ditch or the
overflow elevations apparently because they were not taken. Fill removed for the East-
West lateral ditch located within the wetland boundaries was placed just to the North
adiacent to the ditch within the wetland boundary. Installation of stormwater ponds
adjacent to wetlands at substantially lower elevations may have impacted adiacent
wetlands. It was unclear in permit application submitted that Normal Water Levels
(NWL) of ponds would be placed at these low elevations.
You shall accomplish restoration by doing the following: (continued) also be filled to

elevation will be determined by the existing gas pipe line and approximating the fill over
the line before construction started. Side slopes will be reconstructed at 3: 1 horizontal to
vertical. as was anproved on the [llano The overflow elevation of the 24 inch pipe will be
established at elevation 950.00 msl and the fill over the pipe must be protected from
erosion during over topping. The landowner must formulate a plan for erosion protection
and submit it to the TEP and the Local Government Unit (LGU) for approval. The
location of the 24 inch pipe must be protected by deed recordings specifying its location
invert and over tonping elevation~. All unauthorized fill placement such as that noted
along the East-West lateral must be removed from the wetland. This fill can be used in
the ditch filling and reshaQ!.ng..nrocess, any excess fill will have to be removed from the
wetland boundary. The near Rfoximity of stormwater Ronds with NWL elevations
considerably below wetland levels is of concern for potential drainage of areas of the
wetland in close proximity. This is a potential problem most notably in wetlands 1, la.
and 4a. The landowner must raise the NWL of adjacent [londs to no less than 1 foot
below the corresQonding wetland elevations or must agree to add the Qotentially affected
areas into the required monitoring plan. If monitoring of these areas shows an impact
further compensatory mitigation will be required. The attached map and aerial ph~to
should provide clarification of where these activities must be accomplished. .
