Dear Mr. Francis:
I am in receipt of your August 7, 2003, letter regarding the rear yard grading of 10313 Kali A venue.
As with all lots within Albertville, a swale is required to be graded along the side lot lines to drain
the storm water to either the front or the rear of the lot. With this particular lot, a swale has not been
graded along the side lot lines to carry the storm water to pond in the rear of the lot. That is the
expectation. If you are unwilling to grade the lot accordingly, I will forward this issue onto the city
attorney for appropriate action.

I have finish graded the yard more than once already. Either the City or the Developer
placed stakes with elevations on them to grade to. I did that and supplied an As Built
Survey to the City and I believe that was approved. The only problem at that time was the
homeowner was going to put in an asphalt pad and the slope to the next yard on the other
side ofthe yard.
Because the two yards to the east of this yard are not graded right is not my fault. Get
them right first, then if you need something done to Tom's yard, you need to mark it off
with stakes with elevations. I am not going to guess what you want.
If this doesn't work, you should take it up with the Developer and his plan.
