Dear Mr. Roessler,
This letter is to inform you of the decision reached by the Local Governing Unit (LGU) in regards to the
above mentioned project. The LGU has decided to allow the final proposed project which excludes the
impact, due to stubbing of 55th St. NE which was initially proposed. The approval ofthe project is subject
to the following conditions.
1. Construction of the Sedimentation Ponds must be completed prior to any other construction activity.
2. A number of plattlXllots abut wetlands. These wetland areas as identified on the plat must be protected
with a conservation easement identifying the wetland areas, and stating that the wetlands are protected
under the 1991 Wetland Conservation Act. To assure the wetlands integrity a grass buffer with a
conservation easement must also be developed. The buffer must be a minimwn.16 feet wide and the
easement should protect against alteration of the vegetation. The buffer should be clearly identified and
prior to any lots being sold. Potential homeowners must be made aware of their obligations to protect both
the wetlands and the buffers strips.
3. The proposed replacement wetland must be excavated 6-12" below proposed grade. Any wetland soils
excavated from adjacent wetlands on the property should then be spread 6-12" deep in the basin bottom to
assure a viable seed source exists for establishment of wetland vegetation.
4. Water from the adjacent ditch could be routed in a manner that would flow into the proposed
replacement wetland and an overflow pipe could be established which would produce a pemlanent pool of
3.5 to 4 feet deep. This type of system would create a flow through type of wetland which would closely
resemble what originally occurred. Also a pipe or other outlet control could be designed to increase the
residence time, which would allow tlle wetland to hold more water and distribute it over a longer period of
time, thus decreasing the pressure to the ditch.
5. The excavated replacement wetland area must be graded to blend with existing natural contours and
must feature gradual slopes and irregular shoreline to ensure a functional wetland edge.
6. Newly graded slopes within tlleproposed wetland replacement area must be 5: 1 (horizontal to vertical)
or flatter to reduce the potential for erosion and encourage slope stabilization.
7. All graded area must be seeded in a timely manner and if possible must be seeded within lO days after
final grading has occurred.
8. The replacement wetland must be protected with a permanent easement (see enclosures Form A-Al for
example). Once this is accomplished a copy of the easement must be submitted to this office to be placed
in the file. Please keep in mind if this is not done the certificate of compliance is null and void.
I have enclosed. a copy of a WETLAND CONSERVATION ACT Certificate of Compliance this form
must be signed and returned to our office. Upon receiving a copy of the signed form we will then make a
copy of the Certificate for our files and return your copy which you should keep on-site when the work is
being done.
Please be advised. this permit is not valid until 30 days have passed. from the date you receive this notice.
