Re: 0-313 Otsego/A-5410 Albertville
Roden Petition; 90.45 acres
Dear Mr. Roden:
As you )mow, the Municipal Board received your petition for
detachment from otsego and annexation of same to Albertville on August
1, 1994. At that time, our office asked for a complete and accurate
legal description for the area. As I noted in a telephone conversation
with Mrs. Roden, the petition is not complete until the requirements of
the law are met. A metes and bounds property description was received
on August 10, 1994 and has been forwarded to the Department of
Transportation Mapping Section for review at a later date. You will be
contacted if there are any problems.
Amendments to Minnesota statutes 414, effective August 1, 1994,
also require that the petition be accompanied by a resolution of the
city council of at least one of the affected cities. We have not
received any city resolutions. The Municipal Board cannot schedule a
hearing on this matter unless we receive a city resolution from one of
the cities. If both cities pass concurrent resolutions of support, no
hearing will be necessary. If neither city passes a resolution, a
hearing cannot be held.
Please contact this office if you have any questions.
Sincerely,
PDL:sjh

The anticipated domino, effect
of land detachment requests
a1ongtheOtsegolAlbertville bor-
der has begun.
Two more Otsego property
owners with land on the
Albertville boundary line filed
annexation petitions with the
MinnesotaMunicipal Board last
week.
Their reason: Otsego does not
have nor can it offer immediate
sewer and water service, an el-
ement the property owners say
is essential to the conversion of
their acreage into housing de-
velopments. " '
Largely triggered by the an-
nexation request made by De-

Construction, the first land
asked to be detached was his 80-
acre tract located south' of
County Road 37.
'Then, despite Rod D~Aigle's
claims to, beg off any detach- ,

Annexation
request pits
cities against
each other
by Charmaine Barranco
Staff writer
A request for annexation of an
SO-acre stretch of Otsego land
into Albertville to attain sewer
and water services could plunge
the cities into a costly legal
battle, unless an agreement can
be reached.
Strongly opposed to relinquish-
ing any land and subsequent
residential tax base, Otsego of-
ficials now face a detachment
request which could potentially
trigger a domino effect along
the city's western border.
First to petition the Minne-
sota Municipal Board last month
was Developer Kent Roessler of
Kenco Construction. Roessler
plans to construct several houses
on the SO-acre tract located
south of County Road 37 after
purchasing it from Leander and
Eleanor Becker and Bernice
Aydt.
Meanwhile Rod D' Aigle, speak-
ing on behalf of his father,
Frank, informed the City Coun-
cillast week they too are consid-
ering developing a nearby 60-
plus-acre parcel abutting
Albertville, But unlike Roessler,
D'Aigle favors linking the prop-
erty to a regional sewer and
water system now being inves-
tigated by Wright County be-
fore annexing their land into
Albertville.
Also clamoring for sewer and
water services is Balfany Devel-
opmentInc. of Brooklyn Center,
which owns connecting acreage
in Albertville and Otsego next
to D'Aigle's property. The firm
is re-investigating the possibil-
j ty of transforming its land into
buildable lots outfitted with city
water and sewer.
Yet, despite Roessler's plans,
the Otsego City Council has no
