2000-10-23 Proposed Road System , - -.... MEMORANDUM TO: ALBERTVILLE CITY COUNCIL AND PLANNING COMMISSION; LINDA GOEB, CITY ADMINISTRATOR; FROM: MIKE COURI, CITY ATTORNEY SUBJECT: ALBERT VILLAS FOURTH ADDITION DATE: OCTOBER 23,2000. It is my understanding that at the last planning commission hearing on the Albert Villas Fourth Addition PUD, several St. Michael residents from the developments to the south expressed concerns regarding the inability of the proposed road system to handle the traffic which this development will create. Specifically, the lack of a connection to County Highway 18 seems to be the problem. The Albert Villas Fourth Addition plat does not abut Highway 18, and thus this developer is not able to connect the Fourth Addition directly to Highway 18, although it will be able to connect to streets in Albert Villas Third Addition and to two residential streets in St. Michael. The residential streets in St. Michael are not collector streets and wind around for a distance before ultimately connecting with County Highway 19 in St. Michael. The preliminary plat for the Fourth Addition shows the land between the Fourth Addition and Highway 18 as "Proposed Future Addition." This has apparently led to confusion regarding the ownership of the land abutting Highway 18. Currently this land is owned by Bobby Heuring, not by the developer of the Fourth Addition. The land remains in agricultural production. Whether it will develop, and if so, when it will develop, are not known at this time. Although the developer of the Fourth Addition is attempting to purchase the land, to my knowledge, no purchase agreement has been signed at this point. Under Section A-400.1 and A-400.2 (c), the City Council may deem a development premature and deny the preliminary plat of such development when the roads which serve the proposed plat are such that the increase in traffic volume generated by the proposed subdivision would create a hazard to public safety and general welfare, or aggravate an already hazardous condition. I would suggest the City Engineer and City Planner be consulted on this issue at the Planning Commission and City Council stages. If the developer is 1 ....... - ~ able to purchase the land abutting Highway 18 from the Heurings, I would suggest that the land, or at least a road through that land to Highway 18, be incorporated into this plat.
