Dear Gary:
On Thursday, November 1,2001, you and I met with Mr. Keith Cherryholms, of the MPCA, on site
to review the slope condition of County Ditch 9. Mr. Cherryholms was very concerned with the lack
of turf establishment on the slopes of the ditch that was recently graded. Even though the slopes
have been seeded and mulched, the seed has not germinated and the mulch is not staying in place on
the slope. It does appear that turf will not be established before winter. In order to protect the slopes
over the winter and spring, wood fiber blankets need to be placed on the slopes. The wood fiber
blanket needs to be placed as soon as possible. This type of erosion control is necessary in order for
you and your contractor to comply with your NDPES permit. Without the wood fiber blanket Mr.
Cherryholms indicated that he would issue a cease and desist order until the site is brought into
compliance with your permit.
As agreed in our meeting I will inspect the site again on Thursday, November 8, 2001, to review the
progress of turf establishment and installation of erosion control.
