As the City moves forward with issuing building permits for the 6th Addition, this letter serves to remind
you of the obligation Edina Development has to continue maintaining erosion control for the project
The City of Albertville is requesting that Edina Development Corporation resume a regular program of
sweeping streets and sidewalks in the development At a minimum, streets are to be swept on a weekly
basis and may require more frequent attention. Street sweeping is the developer's responsibility until the
public improvements have been accepted by the City.
If a regular street sweeping program has not resumed by August 23, 2005, the City will arrange to have
the streets and sidewalks swept and will bill the cost back to Edina Development

Dear Mr. Johnson:
This letter shall serve as notice by the City of Albertville that no additional building permits will be
issued for the residential portion of the Prairie Run development until Gold Key Development has
installed the required wetland boundary markers.
According to Article 1.F of the developer's agreement, "Developer shall install, at its sole expense,
markers showing the demarcation of wetland boundaries. The demarcation of wetland boundaries shall be
subject to the approval of the City".
It appears the builders for Lots 14 and 15 of Block 2 may have already disturbed, and perhaps filled, part
of an existing wetland. Until the wetland markers have been installed by Gold Key, we cannot determine
if there has been an impact. Certificates of occupancy will not be issued until the markers have been
installed.
Please arrange to submit a sample of the proposed markers to the City for review as soon as possible.
Gold Key will also need to submit a schedule for location and placement of the markers.
On a related matter, the streets in the development need to be cleaned. Please arrange to have the streets
swept as soon as possible.

Dear Mr. Omann:
On behalf of the City of Albertville, SEH is notifying Omann Brothers, Inc. of the expiration of the
substantial completion date for the subject project. The executed contract for the project specifies the date
for substantial completion is August 12,2005.
As of today, work on the westerly portion of the project has not begun. The lack of substantial progress
has placed Omann Brothers, Inc. in a position where liquidated damages can be considered.
Final completion for the contract is September 16, 2005. Failure to complete the work by this date will
likely result in the City pursuing liquidated damages. The assessment rate is $500 per day, as specified in
the contract.
Please provide me with an updated schedule for completion of the work. Your prompt attention to this

Dear Mr. Fehn:
On August 15, 2005, the City reached an agreement with Robert Heuring to conduct grading and
restoration operations on the Heuring property. The work will consist of slope excavation, tree removal,
turf restoration, and tree plantings (see attached drawing).
Mr. Heuring requested the following items as conditions to the agreement with the City:
1. Any excess topsoil removed during slope excavation operations (up to 100 cubic yards) is to be
spread on the Heuring property east of the new driveway entrance. Excess topsoil is considered to be
any material that is not used for turf establishment on the graded slope.
2. Mr. Heuring is to be compensated at a rate of $3.00 per cubic yard for any excavated material (other
than topsoil) that is removed from the Heuring property.
3. Six maple trees (exact type to be determined) are to be planted along the northwesterly lot line of the
Heuring property.
4. Turf restoration for the graded slope is to consist of sod. Contractor shall be responsible for watering
and maintaining the sodded area for a period of 30 growing days after placement, in accordance with
contract specifications.
Mr. Heuring has removed the building that interfered with slope grading and has scheduled removal of
the demolished foundation.
Please proceed with tree removals and slope grading as soon as possible, to expedite completion of the
contract.
