Re: Potter's Commercial Perk
Dear Commission Members:
Since our letter of June 5, 1989, the developer has submitted a
revised grading and drainage plan and a screening plan. Following
is a list of comments regarding the revised plans and-final plat:-
1. The preliminary plat was approved on June 5, 1989 contingent
on our letter dated June 5, 1989 and recommendations made at
the public hearing May 23, 1989.
2. The developer is proposing to complete percolation tests and
evaluations at the time of application for a building permit.
A variance from section 12-4.2A.9 will have to be granted to
allow for percolation tests at the time of building permits.
3. The grading plan has been revised to show filling to 954.5 of
the building sites and drainf field areas . A U. S . Army Corps of
Engineers permit has been issued to allow for the filling. -
4. The U.S. Army Corps of Engineers permit states that the
roadbed in the wetland is to be removed to help mitigate the
wetland loss resulting from the filling. The developer should
. provide drainage easement over the entire wetland area.
5. In review of drainage, the plat drains to the wetland located
- in the center of the plat. This wetland currently drains-to
the east through an eighteen inch tale drain line which was
partially replaced by an eight inch drain line in November,
1990. The City of Albertville is currently working with the
Minnesota Department of Transportation to obtain funding for
draining the area south through Albertville and easterly to
the Crow River. If this project is built, the plat of
Potter's Commercial park will be required to pay for its share
of the benefit. In the event that the Albertville project is
~_ not built, a taxing district should be created to pay for
future maintenance, repairs and construction of the drainage
system to the east.

6. In review of the screening, we would recommend that an
additional row of deciduous trees be planted in addition to
the coniferous trees. ~ .
7. In review of access to the plat, we discussed the proposed
driveway entrance onto County Road No. 37 with the County and
they indicated they would allow the access.
8. As previously stated, the plat does not show any park
dedication. Therefore, the plat will be subject to cash
paY^nent in lieu of park dedication.
We would recommend approval of the plat contingent on the following
conditions:
1. The developer enters into a performance contract 'with the
Township to complete the plat and escrows for the screening
and ..filling of the' proposed lots. We estimated the cost of
filling and screening of the lots to be $120,000. Therefore,
the required escrow is 150$ of the cost of $180,000..
2. A variance is granted to section 124.2A9 of the township
ordinance requiring percolation tests.
3. The developer provides a drainage easement over the entire
Outlot A and agrees to pay for his share of the cost for the
future drainage improvements to the area.
4. The developer pays the park dedication and road user fees as
required by the Township.
