Dear Mr. Wallner:
Our office acts at City Attorney for the City of Albertville. It has come to our attention that you have requested a
building permit from the City of Albertville for property located at 4904 Kama Lane in Albertville, MN. This
property is located within Albert Villa's Sixth Addition.
Pursuant to Section 14D of the Developer's Agreement for Albert Villas Sixth Addition, the City of Albertville has
the right to deny building permits if the Developer, Edina Realty Corporation ("Edina") defaults on its obligations
under the Agreement. Edina has defaulted on numerous sections of the Developer's Agreement for Albert Villas
Sixth Addition. On AprilS, 2005, the City of Albertville sent a letter to Edina noticing it of these defaults and
provided Edina with thirty (30) days to correct these defaults. The thirty day time period has expired and Edina has
failed to cure the defaults. Consequently, the City of Albertville will not be issuing any building permits, including
the one you requested for property at 4898 Kassel Avenue, unless and until Edina cures the defaults as outlined in
our notice letter dated AprilS, 2005. A copy of that letter is enclosed. Therefore, your building permit request is
denied at this time.

Dear Mr. Hegna:
Our office acts as City Attorney for the City of Albertville. As you are aware, the City of
Albertville provided Edina Development Corporation's ("Edina") with notice pursuant to the
letter dated April 5, 2005 indicating Edina was in default of several sections of the various
Developer's Agreements for Albert Villas, Albert Villas Second Addition, Third Addition,
Fourth Addition and Sixth Addition. That letter further provided that building permits would not
be issued for the Albertvillas Development pursuant to section 14B of the Developer's
Agreements for Albert Villas, Albert Villas Second Addition and Albert Villas Third Addition
and section 14D of the Developer's Agreements for Albert Villas Fourth Addition and Albert
Villas Sixth Addition due to Edina's due to these defaults, unless Edina cured the defaults within
(30) days from the date of the April 5, 2005.
The thirty day time frame to cure these defaults has expired and the defaults have not been cured.
Consequently, the City of Albertville will not issue any building permits for Albert Villas, Albert
Villas Second Addition, Third Addition, Fourth Addition and/or Sixth Addition, unless or until
Edina is able to provide evidence conclusively showing that each of the defaults listed in the
April 5, 2005 letter and the attached "Punch List" has been cured for the respective Addition.
