Also licensed in California June 3, 2003 Mike Thomas Edina Development Authority 700 Industry Avenue Anoka, Minnesota 55303 Re: Albert Villas 6th Addition Dear Mr. Thomas: As you are aware Section 1 G of the Developer's Agreement requires that potential purchasers of any lots within the subdivision be provided certain information prior to the sale of those lots. That information includes: identifying the required thirty (30) foot wetland setback building restrictions, the location of all future parks within Said Plat, and the location of all sidewalks, trails and easements. I have reviewed the packet of materials provided to me by Darryl Fults of Building Sites, Inc. The necessary information has been provided to the builders however, some of the information is being provided by way giving the builders a copy of the Developer's Agreement and attached exhibits. The trail easements for lots 14 and 15 are sufficiently identified by the inclusion of the actual easements in the materials. The 30 foot wetland setback is identified in the restrictive covenants which are satisfactory. The location of the sidewalks, other trails and easements can only be found by way of an exhibit to the Developers Agreement. This is not explicit enough notice of these locations. The City is concerned that the eventual home owners could purchase lots without having been notified of the location of the sidewalks trails and other easements. It is my suggestion that the builders be provided legible copies of Exhibits C, C-I and C- 2 of the Developer's Agreement under a separate specific cover letter identifying them. The cover letter should indicate that the Developer's Agreement requires that these locations be provided to the end users of the lots. If you have any questions or comments please contact me.
