Dear Nina:
It is my understanding that you will be handling the recording of the Albert Villas 6th
Addition plat for Edina Development. The City requires that the closing documents be
recorded in the following order, from first recorded to last recorded:
1. The Albert Villas 6th Addition plat previously approved by the Albertville City
Council.
2. The Developer's/Planned Unit Development Agreement entered into between
the City of Albertville and Edina Development.
3. The Consent to Plat by Contractors Capital Corporation.
4. Declaration of Protective Covenants for Albert Villas 6th Addition.
5. Subordination of Mortgage on Out lot A of Albert Villas 4th Addition to the
Developer's/Planned Unit Development Agreement entered into between the
City of Albertville and Edina Development by Lakeland Construction Finance.
6. Subordination of Mortgage on Out lot A of Albert Villas 4th Addition to the
Developer's/Planned Unit Development Agreement entered into between the
City of Albertville and Edina Development by Contractors Capital
Corporation.
7. The Deed transferring Out lot A of Albert Villas 6th Addition to the City of
Albertville. As previously communicated to Edina Development the date of
the deed should be entered on the date the plat is recorded to prevent a
problem with the chain of title for the Out lot.
8. Partial Release of Mortgage for Out lot A of Albert Villas 6th Addition by
Lakeland Construction Finance.
9. Partial Release of Mortgage for Out lot A of Albert Villas 6th Addition by
Contractors Capital Corporation.
10. Permanent Trail Easement granted to City by Edina Development on Lots 14
and 15 of Albert Villas 6th Addition.
11. Subordination of Mortgage to Permanent Trail Easement granted to City by
Edina Development on Lots 14 and 15 of Albert Villas 6th Addition by
Lakeland Construction Finance.
12. Subordination of Mortgage to Permanent Trail Easement granted to City by
Edina Development on Lots 14 and 15 of Albert Villas 6th Addition by
Contractors Capital Corporation.
13. Off Plat Permanent Roadway Easement granted to City by Edina
Development.
14. Off Plat Permanent Trail Easement granted to City by Edina Development.
15. Subordination of Mortgage to Off Plat Permanent Road Easement and Off Plat
Permanent Trail Easement by Lakeland Construction Finance.
16. Any other documents to be recorded which are requested by the developer or
its lenders.
All documents listed in paragraphs 1-15 must be recorded at the time of the recording of
the plat and in the order indicated. If any of the referenced documents are not available
or if you are unable for any reason to record them in the order indicated, the plat may not
be recorded and you should contact the undersigned immediately.
