Larry/Al/Mike - We've reviewed Al's memo concerning outstanding issues.
While I agree that it is an exhaustive list, there are a couple of items that I do not
think are appropriate for inclusion as topics of discussion when we come out next week -
specifically, the Burger King issues and the Road Issues.
Burger King is not our tenant - they are an outparcel owner. We think the City should be
dealing directly with Burger King to resolve whatever your issues are with them.
Road Issues. While your inclusion of this item does not call for any particular
discussion or action by Chelsea, we want to be clear that we are vehemently opposed to any
plan by the City to use our internal roadways for through traffic.
We would like to meet with Larry and Al at the property at 4pm if you are available to
discuss the remaining issues informally, in advance of the meeting.
We are trying to ascertain the dollar value of the berm removal cost.
Assuming it is not an absurd amount, I think we could likely make a deal along the lines
outlined in Al's memo (i.e. the non -removing party to reimburse the other party its share
of reasonable and documented costs).
On the fence, we agree with Al's point 2A and could agree on some landscaping to address
2B(1), but have serious objections to 2B(2).
For the Pedestrian Traffic issues, we would like to discuss with you the notion of having
our traffic engineer review the situation with Chelsea to implement the recommendations of
our engineer.
The sight lighting issue is entirely new and was a surprise to us.
Nonetheless, we would be willing to re -point our lights so long as we can maintain 3
lumens at all points within the lot.
Finally, on the trash receptacles, we would like to discuss possible landscape
enhancements to improve the appearance of our property, but we would also like to point
out that the hospitality business behind Phase III came AFTER us, and we think our
property compares favorably to the appearance of many other commercial properties in the
City.
Please let me know if you could do an on -site at the property at 4pm on the 25th.

The meeting is scheduled for Tuesday, April 25th at 6:00 p.m. in the Council Chambers.
Attached is a summary of the issues to be discussed.
At one time, we received a letter from Chelsea agreeing to resolve the majority of these
issues. If possible, it would be nice if we could have a pre -meeting phone conference to
try and reach agreement on a number of these prior to the meeting. Please let me know if
you think this is a good suggestion.

Our Traffic, Access Management, and Signing Committee has reviewed the Cities request to install
insurmountable fencing, either in the center median or on the west side of CSAH 19 between the trail and
curb. We have determined that we must deny this request for the following reasons:
There is insufficient space to accommodate snow storage during the winter months;
A fence, in this close of a proximity to the roadway, would be susceptible to damage by
snow coming off of the snow plow; and
Placing a fence in this location would require the removal of already existing and
necessary signing.
We see the problem of pedestrians wanting to cross at mid -block, as an internal problem of the outlet
mall. Two things are currently causing this problem:
1. The opening in the berm, directing eastbound pedestrians to the trail, encourages them to
cross at mid -black; and
2. The line of sight from this point, focuses the pedestrian to look directly at what appears to
be an opening and venue for the pedestrians to walk to (see attached photos), to get to the
outlet shops on the east side of CSAH 19.
Our recommendations to correct this problem is as follows:
1. Have the outlet mall close the current access to the pedestrian trail (fill in the berm) and
construct a sidewalk within the outlet mall property that would direct pedestrians to the traffic
signal.

2. Construct a fence or screen that would block the sight line of an opening to the shops on the
east side of CSAH 19 (see attached photo).
