Dear Mr. Hegna: On June 19, 2006, the City Council of the City of Albertville granted a variance from the wetland buffer strip and wetland structure setbacks (as contained in City Code Section 5000.5B) from 30 feet to 12 feet, consistent with the settlement agreement entered into between the City of Albertville and Edina Development Corporation dated May 8, 2006. This variance was granted for the lots shown on the enclosed Exhibit A. The settlement agreement referenced an Exhibit B which was supposed to list the lots that the City was to consider for a variance. My copy of the settlement agreement does not have an Exhibit B attached to it. However, City Staff believes that the list enclosed with this letter lists all properties which contain wetlands in Albert Villas 1st, 2nd, 3`d, 4th and 6th Additions. Please examine this list carefully to confirm that all properties that your client has an interest in have been granted an easement. Under the settlement agreement, the City must be notified within 14 days of your receipt of this letter if the variance approval is not adequate and Edina Development Corporation desires to declare the settlement agreement null and void. City of Albertville Notice of Public Hearing Variance NOTICE IS HEREBY GIVEN that the Albertville City Council will hold a public hearing at 7:00 p.m. on Monday, June 19, 2006 at the Albertville City Hall located at 5975 Main Avenue NE to take public comment to consider a variance from the requirements of Section 5000.513 of the Albertville City Code —Zoning Ordinance to reduce the wetland buffer strip and structure setback from 30 feet to 12 feet for all lots in the Albert Villas subdivisions that are listed on the reverse side of this notice. All interested persons are invited to attend the meeting and will be afforded the opportunity to voice an opinion during the public hearing. The City Council is considering this variance only for those lots that abut a wetland or are within 30 feet of a wetland. Those lots are listed on the reverse of this notice. 1f your lot is not listed on the reverse of this notice, the variance will not directly affect your lot and you are being provided this notice because your property is within 350 feet of a lot that is listed on the reverse side. For those lots listed on the reverse side, the variance, if granted, will reduce the setback and buffer zone from wetlands from 30 feet to 12 feet. This will generally benefit many of the properties abutting wetlands that have already constructed houses or other structureswithin 30 feet of a wetland. The City Council is considering these variances in part because very . few of the residents who purchased homes in the Albert Villas subdivisions were informed about the 30 foot wetland setback and buffer area and have already substantially modified the buffer area.
