UTILITY PLACEMENT - PAUL WELTER PROPERTY
The followmg IS a Memorandum of Understandmg between the County of Wnght (heremafter
referred to as "County"), Paul Welter (heremafter referred to as "landowner") and Edma
Development CorporatIOn (heremafter referred to as "developer") The purpose of thIS document
IS to establIsh the terms and condItIons for the placement of utIlItIes by developer across pnvate
property belongmg to the landowner m an area WhICh WIll eventually be County lnghway nght-of-
way Said terms and condItIons are as follows
1 As a part of ItS hIghway project SAP 86-618-07, the County WIll be acqumng permanent
hIghway easements extendmg 65 feet from the centerlIne of currently eXIstmg County State Aid
HIghway 18 (CSAH 18) It IS expected that thIS acqUISItIon WIll take place dunng the next SIX to ten
months
2 Landowner agrees to grant a nght of entry to developer for the purpose of excavatmg for
and mstallmg and mamtammg an eIght mch sanItary sewer lIne as well as a twelve mch water mam,
WIth both of Said utIlItIes to be mstalled m the area covered by the future County lnghway easement
3 Developer agrees to mstall saId utIlIty pursuant to specIficatIOns proVIded by the CIty of
AlbertvIlle and accordmg to the terms and reqUIrements of any Wnght County utIlIty permIt Issued
4 Developer agrees to a restoratIOn of landowner's property dIsturbed by saId mstallatIon
work, mcludmg a reseedmg of areas as necessary for eroSIOn control and replacement of crushed
gramte on landowner's dnveway
5 The County agrees to compensate landowner for the permanent hIghway easement
acqUIred accordmg to the fair market value ofthe property, based on land sales of a SImIlar type m
the area Landowner does not Waive any nghts afforded to hIm under Mmnesota law regardmg
emment domam, mcludmg the nght to have the value of the takmg determmed by a panel ofthree
condemnatIOn commISSIoners
6 In the event that any addItIonal temporary constructIon easement IS necessary for the
utIlIty mstallatIOn work, outSIde the lImIts ofthe antIcIpated County hIghway easement, the grantmg
of that temporary constructIOn easement and compensatIon to be paid to landowner for Said easement
shall be a matter to be determmed between the developer and the landowner
7 The proVISIons ofthe Memorandum ofUnderstandmg shall pertam to that real property
owned by landowner as legally descnbed on the attached ExhIbIt A
8 The developer agrees to mdemmfy and hold the County and the landowner harmless from
all lIabIlIty, claims, or actIOns relatmg to mJury or damage to person or property that may, many
manner, result from or anse out of the developer's actIVItIes under thIS Memorandum of
Understandmg LIkeWIse, the County agrees to mdemmfy and hold the developer and landowner
harmless from all lIabIlIty, claims, or actIons relatmg to mJury or damage to person or property that
may, m any manner, result from or arIse out of the County's actIVItIes under this Memorandum of
Understandmg
9 ThIs Memorandum ofUnderstandmg may be modified or amended m wntmg and shall
be sIgned by representatIves of all partIes
