The subdivision does not impact water and sewer service to the sites and will still allow for driveway placement and separation that meet code requirements (40' from intersection). If approved, please add this subdivision information to the files for each lot so we can ensure we receive and review accurate lot surveys when the building permits come in. The lot surveys need to reflect and depict this property line shift and added easement. Also, as part of the lot surveys for these two lots, new property corner monumentation will be required. Hovnanian Homes has applied for a minor subdivision between two lots within Towne Lakes 5th Addition. The proposed subdivision will affect Lot 1 and Lot 2 of Block 1 Towne Lakes 5th Addition at the corner of 68th Street NE and Lancaster Way. The application is to expand Lot 2 by shifting the property line 5 feet to the west incorporating a portion of Lot 1. Currently Lot 2 does not meet the approved housing layouts; therefore, the new lot arrangement will ensure that the home sites are compatible with existing architecture. The minor subdivision will also create a 15 foot drainage and utility easement. Review of the submitted sketch and legal description is found to be satisfactory. Staff recommends administrative approval with the following conditions: 1. On Lot 1 and Lot 2 the garage must be place the on the east property line to meet the required setbacks. 2. The subdivision shall be recorded with the Wright Country prior to receiving a building permit for the lots. CITY OF ALBERTVILLE WRIGHT COUNTY, MINNESOTA ADMINISTRATIVE REVIEW NO.: ADMINISTRATIVE REVIEW APPROVING A MINOR SUBDIVISION FOR LOT 1 AND LOT 2 BLOCK 1 OF TOWNE LAKES 5TH ADDITION WHEREAS, K Hovnanian Homes has submitted an application for a minor subdivision for the properties legally described as follows; and Lot 1 and Lot 2 Block 1 of Towne Lakes 5th Addition WHEREAS, City staff has reviewed submitted plans and prepared a memorandum dated October 10, 2007; and WHEREAS, the Albertville Zoning Administrator has received K Hovnanian Homes' application, site plan, and staff review documents and agrees with the findings and recommendation of City Staff. NOW, THEREFORE BE IT RESOLVED, that the Zoning Administrator of Albertville, Minnesota hereby approves the Minor Subdivision for K Hovnanian subject to the attached Findings of Facts and Decision. Findings of Fact: Based on review of the evidence received, the City Council now makes the following finding of fact and decision: A. The site legally described as: Lot 1 and Lot 2 Block 1 of Towne Lakes 5th Addition B. The memorandum dated October 10,2007 from Northwest Associated Consultants is incorporated herein. C. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. D. Traffic generated by the proposed use is within capabilities of streets serving the property as proposed. E. The requirements of the Albertville Zoning Ordinance have been reviewed in relation to the proposed use. 2 F. The proposed actions have been considered in relation to the specific policies and provisions of and have been found to be consistent with the Comprehensive Plan. G. The proposed use is consistent with permitted uses within the PUD District and will be compatible with present and future land uses of the surrounding area. H. The proposed use conforms to applicable Zoning Ordinance performance standards. I. The proposed use will not tend to or actually depreciate the area in which it is proposed. Decision: Based on the foregoing information and applicable ordinances, the City Council hereby APPROVES minor subdivision based on the most current plans provided planning memorandum and information received to date, subject to the following conditions: 1.
