TENTH AMENDMENT TO MASTER DECLARATION
THIS TENTH AMENDMENT TO MASTER DECLARATION is made in the
County of Wright, State of Minnesota, on this�_day of June,2018 by Towne Lakes
Community Association, a Minnesota non-profit corporation;
WHEREAS, Contractor Property Developers Company,� Minnesota corporation
("Master Developer") filed for record with the Wright County Recorder as Document No.
791007, a Master Declaration of Covenants, Conditions, Restrictuc�ns and Easements for Towne
Lakes.
WHEREAS, Master Developer filed for record on Decerml�er 4, 2003 with the Wright
County Recorder as Document No. 887386 an Amended and Restated Master Declaration of
Covenants, Conditions, Restrictions and Easements for Towne Lakes. (as amended,the "Master
Declaration"); and
WHEREAS, the Master Developer filed for record with the Wright County Recorder as
.Docuxnent No. g39201, a First Amendment to Declaration, adding Additional Property to the
Master Association; and
WHEREAS, the Master Developer filed for record on with the Wright County Recorder
as Document No. 893342, a Second Amendment to Declaration,adding Additional Property to
the Master Association; and
WHEREAS,the Master Developer filed for record with�I�e Wright County Recorder as
Document No. 930495, a Third Amendment to Declaxation, adding Additional Property to the
Master Association; and
WHEREAS, the Master Association filed for record on with the Wright County
Recorder as Document No. 939205, a Fourth Amendment to Dec�aration, adding real property to
the Master Association; and
WHEREAS, the Master Developer filed for record with the Wright County Recorder, as
Document No. 939206, a Fifth Amendment to Declaration, adding Additional Property to the
Master Association;
WHEREAS, the Master Developer filed for record with the Wright County Recorder, as
Document No. 941189, a Sixth Amendment to Declaration, adding Additional Property to the i
Master Association; !I
WHEREAS,the Master Developer filed for record with the Wright County Recorder as I
Document No. 962383, a Seventh Amendment to Declaration, adding Additional Property to the ',
Master Association; �I
WHEREAS, the Master Association filed for record with the Wright County Recorder as ,
Document No. 983987, an Eighth Amendment to Declaxation, adding real property to the Master
Association;
WHEREAS,the Master Developer filed for record with the Wright County Recorder, as
Document No. 1022922 a Ninth Amendment to Declaration, adding Additional Property to the
Master Association;
WHEREAS, Section 2.3 of the Master Declaration provides as follows:
2.3 Annexation of Other Property. In addition to the Additional
Property, other real property may be annexed to the Property and
subjected to this Master Declaration with the prior written approval of(i)
the Master Board, (ii)the Master Developer so long as the Master
Developer owns an unsold Unit for sale or has the right to subject any
Additional Property to this Master Declaration, (iii) the Neighborhood
Developer or Neighborhood Declarant of any new Neighborhood to be
located on the property being added, and (iv)the Neighborhood
Declarant or Neighborhood Developer of any Neighborhood to which the
property is being added so long as it owns an unsold Unit for sale in the
existing Neighborhood. Any property so annexed may be desigriated as
Master Common Elements, or Units, or other Neighborhood Property.
The Master Governing Documents shall be amended, as necessary, to
subject the property to this Master Declaration, and to reallocated Master
Common Expense obligations, voting rights, and memberships, and the
amend to the Master Declaration shall be recorded.
WHEREAS, The Master Developer no longer owns an unsold Unit for sale or has the
right to subject any Additional Property to the Master Declaration. Therefore, the Master
Developer's approval is not required in order to subject additional real estate to the Master
Declaration;

WHEREAS, HSB Ventures, LLC, a Minnesota limited liability company (the
"Neighborhood Declarant") is the owner of certa.in real estate legally described on Exhibit A,
attached hereto (the "Property"). Neighborhood Declarant desires establish a new homeowners
association(hereafter,the"Cottages of Towne Lakes"), and to and subject the Cottages of
Towne Lakes and the Property to the terms of the Master Declaration and otherwise add the
Property to Towne Lakes Community Association;
WHEREAS,the Master Board also desires to subject the Cottages of Towne Lakes and
the Property to the terms of the Master Declaxation and otherwise add the Property to Towne
Lakes Community Association;
NOW THEREFORE, the Master Board and Neighborhood Declarant hereby declare
that the Property is and hereafter shall be subjectto the terms, declarations, covenants,
conditions, easements, charges and liens set forth in the Master Declaration and the By-Laws of
Towne Lakes Community Association(the"Master By-Laws"). This Tenth Amendment to
Master Declaration is made upon the following further terms and conditions:
1. Definitions. All Terms used herein shall have the same meanings as in the Master '
Declaration unless the context otherwise requires.
2. Addition of Nei�hborhood Units and Nei�hborhood Common Elements. The property II
legally described on Exhibit A, attached hereto, is hereby added to the Master �,
Association. The Property will be part of Cottages of Tawne Lakes, a Neighborhood I
Association as defined by the Master Declaration, and designated as units or common '
elements in the Cottages of Towne Lakes Declaration, and all amendments and
supplements thereto. No Master Common Elements will be created out of the Property.
3. Reallocation of Membership in the Master Association, Master Votin� Ri�hts, and
Master Common Expense obli at�ions. '�,
a. In accordance with section 3.4 of the Master Declaration, the Cottages of Towne ,
Lakes is hereby assigned one (1) Membership in the Master Association;
b. In accordance with sections 3.1, 3.2 and 6.1.2 of the Master Bylaws,the Cottages
of Towne Lakes shall be entitled to appoint two (2)voting directors to the Master Board,
each such Director having one (1) vote. The number of voting directors and votes
allocated to the Cottages of Towne Lakes may be adjusted in the future, in accordance
with the Bylaws, based on the number of Neighborhood Associations and number of
Dwellings in each Neighborhood for which a Certificate of Occupancy has been issued.
c. In accordance with Section 6.1 of the Master Declaration, the master common
expense obligations shall be levied as Master Annual and Master Special Assessments
against all Members and allocated among all Members substantially in proportion to the
number of Units in the Member Neighborhood Association. Additionally, the Master
Board may levy and allocate master common expense obligations in the form of
Neighborhood Assessments among only certain Neighborhood Associations in

accordance with the requirements and procedures set forth in section 6.4 of the Master
Declaration.
4. All other Terms Covenants and Conditions Applicable to the Propertv. All of the terms,
covenants, and conditions set forth in the Master Declaration and Master By-Laws shall
apply to the Property and shall otherwise be and remain unmodified hereby.
