RE: Prairie Run Development
Dear Council Members,
It has recently come to my attention that there are some issues regarding the grading plan of a subdivision
I am currently building in,Prairie Run here in Albertville. Specifically,these issues relate to a disputed
elevation of a possible 100 year flood level. This dispute is between the Developer(Gold Key)and the
City of Albertville. Because of this issue,I have been informed that the issuance of all building permits
and certificate of occupancy permits will be halted until further notice.
I feel that these restrictions may indeed apply to some of the lots in this development;I don't believe that it
should apply to all. What I am asking the council to consider is allowing the staff the authority to issue
building permits and occupancy permits in cases where the elevations are not in jeopardy.
After reviewing a letter dated November 29,2005 from your City Attorney,Michael Couri to Gold Key
Development Inc. I read that all of the lots that I currently own are being listed as non-compliant to city
ordinances because the lowest floor elevations are assumed to be below the 2 foot separation of the 100
year flood elevation of 951.5. This is not conect in almost all cases. Lots 21,23,24,Block 2 do not have
any structures on them;therefore no lowest floor elevation has been established yet. Lot 22,Block 2 does
seem to fall below that 2 foot separation by a few inches if indeed the 951.5 elevation is realistic.That is
not what concerns me at the moment.
What I am concerned about are lots 25-28 Block 2. All of these lots have homes currently under
construction and all have lowest floor elevations set at 954 or higher which is.5 foot higher than the City's
2 foot separation requirement. 3 of the 4 homes here are sold and due to close soon. These homes are
listed as non-compliant when,in fact,they do meet the ordinance.
I am asking that the Council release the restrictions piaced on these 4 sites so the families that purchased
these homes can be allowed to occupy and close on their homes in a timely manner. Many things are at
stake here for these people including,but not limited to,interest rate locks,closing and moving from their
current homes,children's displacement from school,the holidays,etc.
I also ask the council to allow the issuance of future building permits when the appiicant intends to place
the lowest floor elevation above the sepazation mazk required by the city.
My hope is that you will consider these two requests reasonable and allow us to proceed.
