After having one developer record the plat but not the developer's agreement,the City instituted a policy that we would either: 1) release a signed plat,developer's agreement and all other recordable documents to a third party closer with instructions on the order of recording of the documents, or 2) require that a City staff member accompany the developer along with the plat,developer's agreement, etc.to the recorder's office with a letter indicating the order of recording. We would then have the developer schedule a time that works for the City to go to Buffalo to record the plat. Last I heard the Developer had to drop the plat off at the County Highway Department or County Surveyor's Office (they were both in the same building before they built the new public works building). From there,the Developer would go to the County Recorder's office, pay all applicable fees, and drop off all of the remaining documents with the recording instructions. The Recorder would examine everything, making sure that all documents were in recordable form. The Recorder would then set everything aside until the plat came through from the County Surveyor and Auditor's office with all of the correct signatures (this usually takes several days). Once the plat arrived,the Recorder would record the plat,followed by the developer's agreement,the other documents required by the City,then the Developer's documents, (mortgages, deeds, etc.). I can prepare the letter for the recorder if you can confirm the documents that we have to record. I know we have the plat, modified developer's agreement and notice of completion of proceedings. Does the completion of proceedings also need to be recorded? Am I just to hold the documents until we hear from the developer?
