SITE PLAN APPROVAL_ PROCEDURE AND REQUIREMENTS. Subdivision A. COMPLIANCE. A site plan must be approved before a building permit for a new structure or..major addition to an existing structure in the Residential, Multiple agelling, Community Store, Commercial, light Industrial, and Heavy Industrial Districts. The purpose of such approval is to assure that new developments conform to City plans and the CityCode, and provide the most appropriate and compatible plan for that area. Subdivision B. APPLICATION. Approval of a site plan may be initiated by the owner, user, or potential user of the subject property by making application in writing to the City on such forms designated by the City. The City may request the applicant to furnish a scaled drawing of any of the following items which the City considers necessary for the proper consideration of the application: (1) Lot or parcel; (2) Existing grades and buildings within 100 feet of the site; (3) Finishing grades amd proposed drainage; (4) Proposed buildomg and their entrances and exits; (5) Interior circulation, including; bike and automoblie parking spaces, loading spacesm driveways, stacking spaces walk, curbing, and lighting; (6) Recreation areas; (7) Proposed landscaping specifications and locations; (8) Existing trees of six (6) inches in diameter or more; (9) Proposed screening; (10) Depth of water and sewer pipes from main to building hookup. Subdivision C. APPLICATION FEES. An application fee, to be set by resolution of the city Council, shall accompany the application. Such fee shall not be returnable. On proof of financial hardship, the City Council may waive the application fee. Subdivison D. PLANNING COMMISSION ACTION. All requests for site plan approval shall be referred to the Planning Commission for review an d r.ecommedation to the City Council. :1 Subdivision E. CITY COUNCIL APPROVAL. All recommendation of the Plan ing Commission shall be referred to the City Council. The Cit;ouncil may affirm, amend, or reject the recommendation of the Planning Commission. Subdivision F. CONDITIONS FOR APPROVAL. The following findings shall be made before a site plan may be approved. The site plan shall: (1) Be compatible with the surrounding land uses; (2) Preserve existing natural features whenever possible; (3) Achieve a safe and efficient circulation system; (4) Not #* place excessive traffic loads on local streets; (5) Conform with City plans for parks, streets, service drives, and walkways; (6) Conform to goals and policies of the City Council.; (7) Achieve maWimum safety, convience and ammenties in the City; (8) Show sufficient landscaping to buffer trRsit-ety features and to enhance the development; (9) Not ba create detrimental distrubances to surrounding properties (10) Stfti-1 meet the requirements of this Ordinance unless a variance has been granted; (11) Show efforts to conserve energy whenever possible; and (12 ) Dew mot'-_aewer_.and- ester pipea 841 4et the requirements of Ordinance 1985-2, Section 2. tAAA_Q'1 (1)c( 4. SECURITY AGREEMENT. 1) PRIOR TO THE ISSUANCE OF A BUILDING PERMIT, THE OWNER SHALL FILE A PERFORMANCE BOND, IRREVOCABLE LETTER OF CREDIT, OR PLACE IN CASH ESCROW AN AMOUNT EQUAL. TO ONE AND ONE-HALF (11) TIMES THE ESTIMATE OF THE CITY FOR THE COST OF THE INSTALLATION OF ALL PAVING, CURB AND GUTTER, FREE STANDING DUMPSTER ENCLOSURES, FREE-STANDING LIGHTING, LANDSCAPING SIDEWALKS, GRADING, AND SCREENING REQUIRED BY THE OWNER. IF THE CITY DETERMINES THAT THE REQUIRED IMPROVEMENTS ARE ADEQUATELY COVERED BY A SECURITY AGREEMENT PREVIOUSLY FURNISHED TO THE CITY, THE AMOUNT OF THE SECURITY AGREEMENT FURNISHED UNDER THIS SECTION MAY BE REDUCED BY THE AMOUNT OF THE DUPICATE COVERAGE. n * For optional consideration by the City Council.. UPON COMPLETION Of THE VARIOUS WORK ITEMS, THE OWNER SHALL APPLY TO THE CITY FOR FINAL INSPECTION. IF THE CITY FINDS THAT ALL INSTALLATIONS MEET THE REQUIREMENTS OF THE APPROVED PLANS AND SPECIFICAITONS, THE SECURITY AGREEMENT SHALL BE RELEASED. HOWEVER, THE SECURITY AGREEMENT FOR LANDSCAPING SHALL BE EFFECTIVE AND HELD FOR ONE (1) YEAR AFTER THE COMPLETION OF THE WORK, IN ORDER TO ENSURE THAT SUCH LANDSCAPING WILL SURVIVE. IF THE IMPROVEMENTS ARE NOT COMPLETED AS PROPOSED WITHIN THE ESTABLISHED TIME LIMIT, THE CITY MAY PROCEED TO MAKE SUCH INSTALLATION BY CONTRACT OR FORCE cYl ACCOUNT,iAD SEEK REIMBURSEMENT OF ITS COST FROM THE SECURITY AGREEMENT. 2) AS A ALTERNATIVE TO PARAGRAPH (1) ABOVE, THE OWNER MAY ELECT TO PROCEED AS FOLLOWS: A) THE OWNER SHALL PAY THE CITY A DEPOSIT IN CASH OR A CERTIFICA'- F OF DEPOSIT IN AN AMOUNT EQUAL TL)1100,0' IF THE ESTIMATED COST OF THE IMPROVEMENTS SPECIFIED IN PARAGRAPH (1) ABOVE, UP TO A MAXIMUM DEPOSIT OF $1,000. THE CITY SHALL ESTIMATE THE COSTS. THE OWNER SHALL EXECUTE AN AGREEMENT AUTHORIZING THE CITY TO ENTER UPON THE OWNER'S PROPERTY TO CONSTRUCT THE IMPROVEMENTS IN THE EVENT THE OWNER FAILS TO CONSTRUCT THE REQUIRED IMPROVEMENTS. THE AGREEMENT SHALL WAIVE ALL REQUIREMENTS FOR AN ASSESSMENT PROJECT UNCLUDING A PUBLIC HEARING AND SHALL PROVIDE FOR THE ASSESSMENT OF THE TOTAL COSTS OF THE PROJECT TOGETHER WITH ADMINISTRATIVE COST OF 1.5' AGAINST THE PROPERTY. THE ASSESSMENT SHALL BE PAYABLE IN ONE INSTALLMENT. B) PRIOR TO OCCUPANCY, THE OWNER SHALL REQUEST A FINAL INSPECTION FROM THE CITY. IF ALL IMPROVEMENTS HAVE BEEN SATISFACTORILY INSTALLED, A CERTIFICATE OF OCCUPANCY SHALL BE ISSUED AND THE DEPOSIT RELEASED TO THE OWNER. IF ALL IMPROVEMENTS ARE NOT INSTALLED, TIE OWNER SUBMITS A SECUIRTY AGREEMENT EQUAL TO 150' OF THE ESTIMATED COSTS OF THE IMPROVEMENTS TO BE INSTALLED BY THE CITY. C) IF THE BUILDING IS OCCUPIED PRIOR TO THE ISSUANCE OF THE CERTIFICATE OF OCCUPANCY, THE CITY MAY CLAIM THE DEPOSIT AS LIQUIDATED DAMAGES FOR COSTS INCURRED BY THE CITY IN ENFORCING THESE PROVISIONS OF THE CITY CODE. The possible range of the shortfall is presently calculated to be anywhere from about $300 to $800 million for the biennium. Tnis potential shortfall could affect 1986 local government aids, and possibly other aids and credits received by cities. Cities should take this possibility into account in preparing their 1986 budgets and in certifying the tax levy to the county auditor. The current state budget includes a $450 million reserve, against the possibility of a revenue shortfall. However, revenue collections to date have been about $100 million below the estimates used in preparing the budget, so the actual reserve remaining is closer to $350 million. Legislative leaders have indicated that if it does become necessary to cut back expenditures, the first cuts will be made in state agency budgets. Tie next area to be cut would be local government aids (possibly including homestead and other credits). The last area to be cut would be school aics. Leaders in both parties in both houses are at this time unwilling to consider tax increases to deal with revenue shortfall. Ur:fortunately, at this time there is no way to predict or estim-ate Ne likely amount of any reduction in local government aids, or even how likely it is that a reduction will be nece--sary. That the Water And Sanitary Sewer Board shall have the power to certify unpaid water service charges for water services provided by the Board for a particular tract or parcel of real property to the Wright County Auditor for collection as taxes are collected. The term "water service charges" shall specifically include, but not be limited to, delinquent water bills and delinquent bills for the correction and repair of water lines on a particular tract or parcel of land.
