As this time, four bills have been introduced in Congress which address the negative implications brought about by subjecting state and local employees to the 1974 Amend- ments to the Fair~ Labor Standards Act (FLSA). H.R. 2866, introduced by Congressman Harold Ford, would amend the FLSA of 1938 to permit employees engaged in law enforcement and fire protection to take compen- satory time off in lieu of overtime pay beyond the pay period in which it is earned. A second bill, H.R. 2936, introduced by Congresswoman Beverly Byron, would exempt. employees of public agencies who are engaged in fire protection or law enforcement from overtime wage coverage in general. This would eliminate all of the provisions of the 1974 Amendments as they apply to fire and police departments. H.R. 3237, sponsored by Congresswoman Virginia Smith, would amend the FLSA to exempt from the overtime requirements of the Act all employees of state and local public agencies. This bill would also clarify the application of the Act to volunteers. A bill similar to H.R. 3237 has been introduced by Congressman Hal Daub. This bill will also exempt all state and local governments from the overtime provisions of the FLSA, retroactive to February 19. It will also exempt individuals providing volunteer services to state and local governments from the minimum wage and over- time provisions of FLSA. Although I have signed on as a cosponsor to each of the above bills, 1 strongly support H.R. 3237 which is the companion bill to the Senate version, S.1570. My first choice would be for Congress to pass a bill which would alleviate the pro- blems caused by the 1974 FLSA Amendments for all state and local employees, as opposed to one or two specific groups. Currently, all of the bills amending the FLSA are pending and hearings have not yet been scheduled. it is hard to speculate at this time which of the bills will receive legislative action. However, as more people become aware of the adminis- trative, budgetary, and implementation problems resulting from the Garcia Court case, the more our chances to remedy the situation increase. The Supreme Court ruled last "`February that state and local gov- ernments must adhere to the Fair iLabor Standards Act. I The decision prompted an outcry 'from local governments, and a de- nunciation from Meese, who told the American Bar Association last July that the ruling "undermines the -stability" of state and local govern- ments. The National League of Cities and other organizations said the court's 5-to-4 decision in Garcia v. It said that it would require police 'o be paid overtime if they work 171 hours in a ' 28-day. period, and firefighters if they work more than 212 hours. Los Angeles officials have said the ruling would force them to spend $100 million a year, and, some municipal officials have said that it would force them to lay off employes and reduce services. Lo- cally, the District government es- timated that it would have to pay up to $15 million a year to comply. The case originated with Joseph Garcia, a San Antonio bus driver who challenged the city's practice of paying overtime only when driv- ers worked on their days off and . holidays. The American Federationl' of State, County, and Municipal: Employees, which supported Gar- cia, said yesterday it would vigor ously oppose efforts to overturn th ruling. Republican Sens. Pete Wilson California and Don Nickles of Oklf- homa have backed a bill that would, overturn the Supreme Court's r - ing. DEVELOPER AGREEMENT AGREEMENT, made this day of October, 1985, by and between ALBERTVILLE INDUSTRIAL DEVELOPMENT COMPANY, a Minnesota General Partnership, hereinafter, "Developer" and THE CITY OF ALBERTVILLE, a Minnesota Municipal Corporation, hereinafter 'City". W I T N E S S E T H: WHEREAS, Developer had caused to be platted a plat known as, BARTHEL'S INDUSTRIAL PARK, located in the City of Albertville, Wright County, Minnesota, which plat includes the following des- cribed residential lots: and; Lots 1 through 19, Block 5; Lots 2 through 6, Block 6; Lots 1 through 10, Block 7; Lots 1 through 6, Block 8. WHEREAS, the city streets providing access to said lots in accordance with said plat, namely, Lannon Avenue, LaSalle Circle and Larabee Circle, do have sewer and water service, storm sewer, but do not have bituminous surface or curb and gutter; and WHEREAS, Developer has sold and intends to continue to sell the above described lots located in Block 5, 6, 7, :and 8, prior to the above mentioned street being surfaced with a bituminous surface and curb and gutter; and WHEREAS, the Developer and the City desire to agree in regard 1'110NI, T --, 84 AMENDMENT TO THE RESOLUTION WHEREAS, the City Council of Albertville ( the "Council") appointed by resoluiton a new Designated Authorized Represenative to the Minnesota Pollution Control Agency; and WHEREAS, it is the interpretation of the Minnesota Pollution Control Agency that "City Administrator and City Clerk" requires the signature of both parties. NOW THEREFORE, BE IT RESOLVED, that the resolution designated a new Designated Authorized Representative shall be amended to read as follows: ...That the City of Albertvi.11 appoint the City Administrator or the City Clerk as the Designated Authorized Representative to the Minnesota Pollution Control Agency. NOW, THEREFORE, based on the mutual covenants contained here- in and other good and valuable consideration, it is agreed as follows: i. The City does hereby authorize: Developer to continue to sell lots owned by Developer and bordering on Lannon Avenue, LaSalle Circle, and Larabee Circle, which lots are more specifically described as follows: Lots 11 through 19, Block 5; Lots 1 through 6, Block 6; Lots 1 through 10, Block 7; and Lots 1 through 6, Block 8; BARTHEL'S INDUSTRIAL PARK, Wright County, Minnesota. prior to said streets receiving a bituminous surface and curb and gutter. 2. Developer does hereby agree and does hereby guarantee, on behalf of the partnership and the partners, to pay for the cost of bituminous surface streets and curb and gutter bordering on the lots described in paragraph 1 above allocated to those of the above described lots which had been sold prior to the bituminous surface streets being constructed. Payment shall be made as to all of said lots which have previously been sold after the bituminous surface and curb and gutter is installed and after. the City has determined the cost of said bituminous streets and curb and gutter attributed to each of said lots but prior to the sold lots being -2- r assessed on the county records for the cost of said bituminous � surface and curb and gutter. Developer does further agree to pay the assessment against all other lots for the cost of said bituminous surface as well as any previous or future assessments when said assessments are due. 3. The agreement by Developer in paragraph 2 above is based on the presumption that when Developer sells any of the lots described in paragraph 1 above that Developer will sell those lots with the understanding and agreement with the buyer that the Developer will pay the costs for the bituminous street surfacing attributed to the lot being sold to buyer. in the event that Developer sells any of the lots described above to a buyer with the agreement that the buyer will pay the cost attributed to that lot for bituminous street sur- facing then, Developer shall not be obligated to pay the cost of said bituminous street and curb and gutter, surface assessed against said lot but rather the buyer may pay said assessments as they become due. 4. That except as agreed herein, all previous agreements by and between the City and Developer in regard to the payment for assessments and the further development in Barthel's Industrial Park, Wright County, Minnesota, shall remain in full force and effect. Although we believe that paragraph D of the Operating and Authorization Agreement is void as against public policy, and I have advised Albertville that when the matter proceeds to its final conclusion that the City will prevail, we are anxious to resolve the matter at the present time so that Albertville, St. Michael, Frankfort and Hanover can all get about their business in connection with their joint powers responsibilities under the joint powers agreement. Therefore, we are willing to offer to you the sum of $5,000 to resolve the matter. Walsh Mayor, City of Albertville City Hall Albertville, Minnesota 55301 Dear Mayor Walsh: RE: Project Construction Municipal Wastewater Treatment Construction Grants Program Project C271087-02, Step 3 City of Albertville Notice of Violation On behalf of the Minnesota Pollution Control Agency (MPCA) staff, I want to thank you for your time and the City's cooperation during the meeting and subsequent construction inspection of the City's ongoing wastewater treatment project on August 13, 1985. As you know, the purpose of the meeting and inspection was to address our concerns regarding the installation of the high -density polyethylene (HDPE) synthetic liner. Our primary concern with the installation relates to the adequacy of the seaming of the 20 mil HDPE panels. Previous construction inspections by the MPCA staff and subsequent discussion with management personnel in our Technical Review Section resulted in the August 13th inspection with Mr. Gordon Wegwart, Section Chief and Mr. John Hensel, Supervisor. Both Mr. Wegwart and Mr. Hensel were very interested in further investigating the previously reported observations regarding the installation of the liner. As you are aware, three seam samples (coupons) were cut from three different seams. It is our understanding that half of each coupon was tested by Poly -America, Inc, and the other half by Twin City Testing using appropriate seam tests. The MPCA staff has reviewed the test results submitted to us by Mr. Kenneth Ashfeld of Meyer-Rohlin, Inc. on September 24, 1985. [40 CFR 35.2214 Grantee responsibilities "(a) The grantee shall complete the project in accordance with the grant agreement including... the design drawings and specifications..."] Alleged Violations: On September 3, 1985, Mr. Kenneth Ashfeld, consulting engineer for Meyer-Rohlin, Inc., sent the MPCA staff five laboratory reports from Twin City Testing and Engineering Laboratory, Inc. (Twin City Testing) numbered 4140 86-438-1 through 4140 86-438-5. It is our understanding that Report 4140 86-438-1 contained the tensile test results from the coupons collected on August 13, 1985. Other coupons were tested and the results reported in 4140 86-438-2 and 4140 86-438-3. Tensile strength of the coupons, in pounds per inch of width, varied from 32.9 to 55.3. It is our understanding that Report 4140 86-438-5 contains the results of peel tests done on Sample 4+OOW 5+50 from at least one of the three coupons collected on August 13, 1985. The results show an average adhesion strength of 9.4 pounds per inch of width. It is also our understanding that the tests performed by Twin City Testing represent failure of the samples at break, were recommended by officials from Poly -America, Inc. (Poly -America), and that Poly -America's results, though not available yet in writing, are essentially the same as Twin City Testing's as has been stated by Mr. Ashfeld. On August 13, 1985, at our Albertville meeting, Mr. Wynn Alterman of Poly -America gave the MPCA staff test results for coupons sampled on August 5, 6, and 7, 1985. These test results show an average shear adhesion (tensile strength) of 73.8 pounds per inch width, and an average peel adhesion strength of 42.6 pounds per inch width. Clearly the test results from Poly -America for tensile strength (shear adhesion) of 73.8 pounds per inch width are significantly different from Twin City Testing's results of 46.0 pounds per inch width (average of averages from the three reports). Although the specifications do not require a peel adhesion test, the test results for peel adhesion from Poly -America of 42.6 pounds per inch width are significantly different from Twin City Testing's results of 8.7 pounds per inch width (average of averages from Report 4140 86-438-5). 3 Subsection 3.0, "e", Field Seams, of Section 2 of page 2-15 of the "Specifications for 1984-1 Improvement Project, Albertville, Minnesota" (specifications), approved by the MPCA staff on June 19, 1984, states that "...The field seams shall be constructed so that the seam in shear is as strong as the sheet..." Subsection 3.0 "c", Materials, of Section 2 on page 2-13 of the specifications states that the minimum requirement for polyethylene in tensile strength, at break, in pounds per inch width is 75. Section 4, Synthetic Liners, of Addendum Number 1 of the specifications, approved by the MPCA staff on September 5, 1984, states that "...it is the intention to not specify a specific mil thickness. The specification requirement is for the liner material to meet all the minimum requirements as given..." The specifications go on to warn bidders that "...The general contractor shall ensure himself, prior to submission of the bids, that the manufacturer quoting the synthetic liner does in fact meet all the minimum requirements and is not simply quoting a basic 20 mil liner. Liners not meeting the specifications will be rejected." It is apparent that the minimum tensile strength specification for the field seams have yet to be met, but the test results submitted by Mr. Alterman on August 13, 1985 show that the field seams were very close to meeting the specification. Twin City Testing's results indicate a failure of the seams to meet the minimum tensile strength of 75 pounds per inch width. In the case of the one coupon, test strips broke at 32.9 pounds per inch width, a 56 percent reduction in the minimum tensile strength. It is our position that this type of reduction is a substantial reduction in the tensile strength as required by the P&S. It is the MPCA's position that Twin City Testing's results demonstrate a clear failure of the seamed liner to meet the minimum requirement of 75 pounds per inch width in tensile strength. It is the MPCA's position that the liner should have been rejected under the provisions of Section 4 of Addendum 1 to the P&S. It is also the MPCA's position that the intent of the specifications was to put bidders on notice that, if a high -density polyethylene (HDPE) liner greater than 20 mils in thickness were necessary to meet the minimum requirement of 75 pounds per inch width in tensile strength for the field seam, that the general contractor getting the contract would have to provide a liner thicker than 20 mils. (2) 40 Code of Federal Regulations (CFR), Subpart H, Section 30.900, Project Changes and Grant Modifications: "(b) The grantee must promptly notify the Project Officer in writing (certified mail, return receipt requested) of events or proposed changes which may require a grant modification: ...(2) Changes in approved technical plans or specifications for the project..." Alleged Violations: As stated before, it is the MPCA staff's position that the documented reduction in the tensile strength of the seams is a substantial reduction in the specified seam strength that represents a substantial change in the approved specifications for this project. This change should have been requested of and approved by the MPCA staff prior to the installation of the synthetic liner. PLEASE BE ADVISED that if the City of Albertville does not submit a Corrective -Action Plan (CAP) to the Minnesota Pollution Control Agency staff within thirty (30) days of receipt of this Notice of Violation (NOV), the MPCA staff may be forced to proceed with termination or annulment of the City's grant in accordance with 40 CFR Section 30.920 through Section 30.920-6. PLEASE BE ADVISED that at a minimum, the CAP shall include the following: a. Specifically what actions the City proposes to correct the cited deficiencies; b. A date -specific schedule for completing the corrective actions; 5 C. If the City asserts that the specifications have been met, a comprehensive report must be submitted within the same time requirements as the CAP representing a synthetic liner industry -wide consensus supporting acceptance of the liner. The report shall contain written statements from at least three synthetic liner manufacturers of HDPE liners, other than Poly -America, supporting acceptance of the liner as installed. The passage of this amendment would alleviate potential legal actions that cities could be faced with. The City Engineer, Ken Ashfeld and two Council Repre- sentatives had an opportunity to inspect the site and decided that it might be beneficial to get the adjacent property owner together to discuss the problem. The Albertville City Council has requsted that you or your repre- presentative attend the September 16th Council meeting to discuss the problem in detail. The Council will try to take the issue up as close to 8:00 p.m. as possible so that you will not be delayed any longer then necessary.
