RITE CABLE COMPANY OF MINNESOTA, LTD. • October 9, 1985 Dear Mayor Walsh and Council Members: Rite Cable Company has been working very hard to do the necessary pre - construction steps to building cable in the Albertville, St. Michael, Dayton, and Otsego area. Our plan, as I previously described it to you was to complete the mapping, apply for pole contracts, locate the potential pole clearance violations, request the utilities to make the necessary rearrangements, submit our routing maps to Magnavox for design, begin to track the completed utility rearrangements that coordinate with our planned contruction and then have our aerial contractor move smoothly from Sherburne/Wright into Albertville, St. Michael, Dayton, Otsego new build area. Our aerial contractor, however, completed the Sherburne/Wright build over thirty (30) days in advance, and we were at a loss as to what to do with the crews until our preliminary work in your area was finished. To put it simply, ^ they cannot stand and wait. I figured out that by the time we relocated them for five or six weeks, and then tried to bring them back to Minnesota, we would be in the middle of the holiday season. The next six to eight weeks consists of weather that is nearly impossible to work in outside. We have therefore, decided to continue the pre -construction work, and ready everything for a fresh construction start in the spring. I'm certain that when you consider all these factors, you will see the timetable predicament in which we have found ourselves, and understand this course of action. I would be happy to attend a council or board meeting and give you a more detailed update, if you decide that is needed. TO: The City of Albertville FROM: Jeff Dow, President Humane Society of Wright County Enclosed is a copy of our Animal Impound Contract with the cities and townships in Wright County to provide impound services for lost, stray, abandonded and injured animals within their jurisdiction. Our records indicate that your city is not currently contracting with us to handle any stray dogs or cats from your area. We encourage you to review this contract at this time, and to make the decision in favor of signing it and returning it to us. This decision provides you and your constituents with a workable solution to the stray dog and cat situation which does exist here in Wright County. Our first six (6) months (March through August 1985) in operation as an animal shelter and impound facility have only proven to reinforce this issue, as we currently re- ceive something over 100 calls a month from concerned citizens about lost, home- less and troublesome animals in their neighborhoods. Until now, without your help, we have been unable, for financial reasons, to assist these citizen callers from your area. It is noteworthy that the vast majority of individuals who do phone us are quite distressed to find out that their elected officials have not chosen to enter into this agreement with us. Further, we remind many, many people each month, and would like to remind you again, as well, that we receive NO government funding from ANY level to support our efforts to help the people and pets of Wright County. Our only income is from pet adoptions, cash donations, and impound fees. Again, please consider your position in this matter, and return one copy of the signed contract in the envelope provided. An additional copy is enclosed for your records. This contract represents an agreement between The Humane Society of t Wright County and The City of Albertville to provide animal impound services for stray dogs and cats within the jurisdiction of said city 2. This service will be provided during normal business hours, 7 days a week except Hosidays, ONLY WITH PRIOR AUTHORIZATION FROM A CITY OR TOWNSHIP OFFICIAL. Those business hours shall be: Monday through Friday, 12 to 5 p.m. Saturday 10 to 5 p.m. and Sunday 1 to 4 p.m. 3. At this time, the stray animal must be transported by a concerned citizen and/or city or township official to the impound facility located lk miles east of Delano on MN State Hiway 12. The Humane Society is unable to provide pick-up services for the animals at this time. 4. Animals brought in will be held for the required five working days and, if not claimed by the owner, will be put up for adoption or be euthanized, at our discretion. Every attempt will be made by The Humane Society to locate the owner(s) of stray pets. 5. If the animal is claimed by the owner, the owner will pay all boarding costs plus any fines or license fees imposed by the city or township. The fines or license fees will then be turned back to the community involved. 6. Impounding fees will be as follows: DOGS: 5 days boarding at $4.00 per day ...... $20.00 CATS: 5 days boarding at $3.00 per day ...... $15.00 Ninety (90) per cent of all pets we receive as strays become the property of The Humane Society and are put up for adoption after the required holding period. In the rare event that an animal is not considered an adoptable pet (age, condi- tion, illnes, etc.), an additional $10.00 per dog and $8.00 per cat will be charged for euthanasia and disposal fees. NOTE: All dogs having positive heartworm tests will be euthanized regardless of age, breed, or condition. Payment for any impound services provided will be required on a monthly basis, upon receipt of a monthly statement. P.O. Minn.55313 Phone 612-682-1781 August 22, 1983 Honorable Mayor and City Council c/o Don Berning, Clerk Albertville, Minnesota 55301 Re: Feasibility Study Members of the Council: We have examined the estimated costs associated with improving the north frontage road abutting the Hackenmueller's shopping site. The study area consists of an existing gravel road within the City of Albertville. The existing gravel structure appears to be in fair to good condition but the surface is warped to some degree. We dug 3 test holes in the existing structure and found from 6" to 10" of gravel underlain by a cohesionless sand. Proposed improvements consist of blading the road to a proper cross-section, applying 6 inches of additional gravel, and paving with a 11" layer of bituminous base and li" layer of bituminous wear. The north side should not have to be disturbed but the south side will need black dirt to prevent erosion. The estimated cost of the above described improvements including construction, engineering, legal and administrative costs is $8,300. This estimated cost assumes that this project can be done in conjunction with a larger project to get better prices. The above proposals are feasible and would result in an improve- ment to the abutting benefited property. If you have any questions, please contact me. I am sure that there will be many comments and additions to it. In 1981 the Joint Board adopted an amendment to the operating agreement which allowed the Board to adopt appropriate regulations by Resolution without amendment of. the Operating Agreement; meaning, that the Board can act on its own. In my review of the documents which have been adopted from time to time by the Board, there does not appear to be a comprehensive set of regulations governing connection, materials, subdivision hook-ups, capacity allocation, etc. The enclosure addresses one issue, that of connection of a single premises. I believe that a comprehensive approach to regulations would be in the best interest of the Board. This would seem a particularly appropriate time because, as I understand it, the various member communities are considering regulations at this time which would relate to development and the water system. Hoff HOFF & ALLEN GCh:1p RESOLUTION REQUIRING SITE PLANS BEFORE CONNE(_-TION WHEREAS, the Hanover, Frankfort, St. Michael and Albertville Water and Sanitary Sewer Board are authorized to adopt appropriate regulations concerning persons making connection to the Joint Powers Water System by amendment to the Operating and Authoriza- tion Agreement dated February 3, 1981; and WHEREAS, certain regulations are needed to assure appropriate construction and connection to the water system; NOW, THEREFORE, IT IS HEREBY RESOLVED by the Hanover, Frankfort, St. Michael and Albertville Water and Sanitary Sewer Board as follows: 1. Site Plan Required. Before any person shall be issued a permit to connect with the Joint Powers Water System, he shall provide to the Water Superintendent or System Operator a site plan which will show the proposed connection. The site plan shall include all information reasonably required by the Water Superintendent or System Operator including, but not necessarily limited to, the following: (a) A description of the premises to be served, including number of toilets, sinks, and other water connections. (b) The water line which will connect the premises to the water system; including, the depth of said line, type of material, type of cuppling, location of meter, location ^ of stopbox and size of connecting pipe. (c) A description of all disruption or excavation to be done on public property or easements and the plans for restoration of the same. 2. Upon presentation of the site plan above referenced, the Water Superintendent or System Operator shall review the same to see that it is in conformance with all State Building, Plumbing and Health Department requirements and all regula- tions adopted by this Board. If it is found to do so a permit to connect shall be issued. If not, no such permit shall be issued and the applicant shall be directed to amend his site plan. 3. After completion of the construction the installer shall provide to the Water Superintendent or System Operator an "as -built" plan which will include at a minimum the items set forth above with certification that the installation has been made in conformity with the approved site plan. -I- 4. No water service shall be allowed to the premises until such time as the "as-builts" are provided to and approved by the Water Superintendent or System Operator. Provided, however, that in the event the Water Superintendent or System Operator determines that the installation is actually not in conformity with the site plan and the "as-builts", actual use of the system may be denied. 5. In the event that there is to be excavation done on public property requiring restoration activities, the Water Superintendent or System Operator may require security for restoration of the public right-of-way in an amount deemed sufficient by him. Said security may be either in the form of a letter of credit or appropriate performance bond with accompanying agreement related to restoration activities. It should be noted that in order to ensure the health and safety of the public, who regualrly visits our shelter in search of adoptable pets, NO animal who has bitten a person and is suspected of having rabies will be impounded at our shelter. Minnesota State Statues require that local law enforcement officials provide such a service. 8. This contract will be reinstated on an annual basis, and may be terminated by either party upon thirty (30) days written notice. Minnesota 55301 Dear Fire Chien VetScn: This letter is to confirm that the Fire Department has reserved the use of the City Hall and the Fire Barn for the annual Fire Department's Fund Raiser on October 18, 1985. In addition, the City Council approved the 3.2 Beer License for the Fire Department at its regular meeting on October 7th. The City, however, has some concerns with the fact that the evening's events has been advertised as "Vegas Night". The City also understands that Vegas Night does not necessarily mean that you are gambling for money which is illegal, pursuant to Minnesota State Statute 349.13.
