JULY 21, 1986
The regular meeting of the Albertville City Council was called to
Order by Mayor Jim Walsh. Members present included Gary Schwenzfeier,
Donatus Vetsch, Don Cornelius, and Bob Braun. Others present included
Maureen Andrews, Donald Berning, Barry Johnson, Ken Lindsay. Gary
meyer was absent.
There was a motion to approve the minutes made by Donatus Vetsch
and seconded by Bob Braun. All were in favor.
Mr. James Daniels, General Manager of Rite Cable Company was present
to update the Council on the progress of getting Cable TV into the City.
The Council was informed that the contruction of the entire project is
about ' complete and that Albertville was almost complete. The next
step once the cable is all strung the cable will then be spliced together
and test signals will done. It is expected that all this work will
be done in the next 60 days or so.
The Council members then had a opportunity to ask mr. Daniels some
questions about the system and was given this additional information.
How is the Cable installed?
The cable is installed the same way as existing utilities --so if the
area has all overhead then the cable goes on the overhead poles and if
the area has underground then then the cable will be installed under-
ground.
Do residents have to hook up to Cable?
No, all residents will have the option of hooking up to Cable when Rite
Cable starts the residential hook-ups.
What will the rates for Cable Service be?
The current rate structure of the Buffalo systems will be charged for
service in Albertville. Packages will range from $16.00 to $90.00 depending
on the extras ordered.
Does the City have any control over rates charged?
No, federal regulations took those powers away from the cities and made
it the responsiblity of the supplier.
Would it be possible to complete the installation of the cable in the
areas that are scheduled for street improvement project is started?

There was a motion made to set a public hearing for Ordinance 1986-3
amending Ordinance 1975-6, RELATING TO PARKING WITHIN THE CITY OF
ALBERTVILLE, for August 18, 1986. The motion was made by Gary Schwenzfeier
and seconded by Don Cornelius. All were in favor. The time of the
hearing will set by Maureen at the time she publishes the notice.
There was a motion made by Don Cornelius and seconded by Donatus
Vetsch to set a public hearing for Ordinance 1986-4, AN ORDINANCE
REGULATING WEIGHT LIMITATIONS WITHIN THE CITY OF ALBERTVILLE. The
hearing has been set for August 18th at a time set by Maureen. All
members were in favor..
Mr. Carl Welter was present to request a public hearing to sub-
divide his lot so that his son can build a house on part of the land.
The lot will equal 4.19 acres more or less and will have frontage on
Jason Avenue (C.S.A.H. 118).
There was a motion made by Gary Schwenzfeier and seconded by Don
Cornelius to set the public hearing for August 18, 1986 at a time set
by Maureen. All members were in favor.
Mr. Clem Marx and Mr. Virgil Pouliot were present to discuss the
needed easements for the storm sewer line and the extension of Lander.
There was a discussion on the project and what needed to be done.
Maureen was asked to have Doug at the next Council meeting to continue
the discussion.
It was also agreed that Maureen and Gary Meyer would be available
to meet with their attornies to discuss the easements if it was needed.
It was also explained that at the time of the Assessment Hearing if
it was shown that the property would not benefit from the improvement
(Pouliot's) that the Council could defer the assessment until such time
that a varaince be granted on the property frontage requirement of 90'
which the property does not meet. At such time that a variance was
granted then the assessment would have to be paid.
The following building permits were approved on the following
motions:
Permit # 37: 11720 57th Street for G.L. Anderson -- New Home
Motion was made by Don Cornelius and a second by Gary Schwenzfeier.

Permit # 38: 5154 Lannon Avenue for Barthel Construction -- New Home
Motion was made by Donatus Vetsch and seconded by Bob Braun. All
members were in favor.
Permit # 39: 11673 51st Street for Dayton Perry -- New Home.
Motion was made by Don Cornelius and seconded by Gary Schwenzfeier.
All members were in favor.
Barry reviewed with the Council information regarding having
MARKHURD supply the City with topographic maps of the undeveloped
areas. (These areas are shown on the attached map) The purpose of
using this service to to determine where lift stations and new sewer ,/—�5%cm S0 (1EZ
lines can and should be located. The cost to do the work will run
$3,200.00 and change back to persons buying copies of the topos. After
some discussion it was decided that the City would charge $16.00 an acre
for copies of the topo map.
There was a motion made by Don Cornelius and seconded by Donatus
Vetsch to approve the MARKHURD contract for $3,200.00 and to charge
$16.00 an acre for copies. All were in favor. It was also decided
that the originals would be kept at Meyer-Rohlins offices because they
have the equipment needed to make prints. The Council asked to have
it noted that the funds should come out of the Sewer Account since it
is aiding the overall sewer system.
A representative of Progressive Contractor's Inc. was suppose to
be present at 8:00 p.m. to discuss why the project had not been completed.
The Council waited for someone to show up and no one did so the issue
was tabled until the August 4th Council meeting. The request for
payment 415) was also tabled until the 4th.
There was some discussion about the Junk Cars. Maureen was asked
to check with Gary Meyer to see what the City's next step in enforcing
our Ordinance is. Maureen was also asked to contact some towing companies
regarding their charges for towing the vehicles.
There was a motion to change the Bid Opening date from August 21st
to August 28th made by Donatus Vetsch and seconded by Gary Schwenzfeier.
All were in favor.
There was a motion to change the improvement Hearing date to
August 28th so that the bids would have been opened before the hearing.
The motion was made by Bob Braun and seconded by Donatus Vetsch. All
were in favor.
Ken Lindsay informed the Council that Dennis Fehn had moved the
dirt taken out of the ditch last fall so that Truss Manufacturing could
blacktop their driveway. The dirt will be saved until the decision is
made whether or not to extend the ditch.
Ken also questioned the Council about the possiblity of changing
the parking on 60th Street. Maureen was asked to check with Wayne
Fingleson of the County to see who has ownership of the street and to
check with MN/DOT to see if any funds are available to make that into

a Park and Ride lot. The plan would be for diagonal parking on one side
of the street and no parking on the other.
The Council started the discussion on garbage collection for the
City. Maureen was asked to put a notice in the paper that the Council y/
will be discussing the matter at the next Council meeting and interested
residents are welcomed to come and discuss the matter.
Ken asked about seal coating. It was agreed that Barry and Ken will
go out and look to see what areas need to be patthed and Barry will then
get back on the final cost of seal coating.
The Council also talked about sealcoating the entire city and bonding
for the entire project. Maureen was asked to talk -:to Jerry Shannon
regarding this matter.
Other items discussed included sewer line cleaning, overtime pay
for Ken and gravel for the tops of the dikes from the penalty money from
PCI.
There was some discussion regarding the last Joint Powers meeting
but no action was taken. The discussion focused on having each city
require the final grade for water shutoffs shown on the plans so in
case of an emergency Munitech would be able to locate the valve.
The bills were reviewed. There was some question regarding who
had authorized the Black Magic for 50th Street. Maureen was requested
to notify Frankfort Township that in the future the Council should
be notified ahead of time that this type of work is going to be done
so that the Council has an opportunity to review and approve the
work ahead of its completion.
There was a motion made by Don Cornelius and seconded by Donatus
Vetsch to approve all but the PCI payment which was pending from the
July 7th meeting. The members were all in favor and bills '7339
through -7 3(,3 were paid.
Other items discussed included having Ken get someone out to grade
in front of Hackenmueller's store. Barry was also.asked to update the
figures on improving the street in front of the store and Maureen
was asked to contact Vern and request that he come to the Council meeting
so that the matter could be discussed.
The Council was also informed that the Lions are thinking about
putting up a 25'X66' building behind City Hall to be used in part by
the City for storage. No action was taken.
Maureen was asked to write letters to the groups that were invloved
in remodeling the backroom, for the Jaycees for their work in the Park
and to Keith Franklin for the City Sign.
The was a motion to adjourn made by Gary Schwenzfeier and seconded
by Don Cornelius. All were in favor and the meeting was adjourned.

The City Council of the City of Albertville, Minnesota does ordain:
Ordinance 1975-6, entitled "AN ORDINANCE RELATING TO PARKING WITHIN
THE CITY OF ALBERTVILLE, MINNESOTA" is hereby amended by the addition
of Section 2(A), after 2 and preceeding Section 3.

It shall be unlawful to park a(simi-tractor trailer for more than
one hour in the following zoning: On either side of Main Avenue (C.S.A.H. 35)
from County State Aid Highway ( C.S.A.H) 37 southernly along said Main
Avenue to 50th Street (C.S.A.H. 35).

ORDINANCE NO. 1975-6
AN ORDINANCE RELATING TO PARKING WITHIN THE
CITY OF ALBERTVILLE, MINNESOTA
The City Council of the City of Albertville, Minnesota,
ordains:
1. It shall be unlawful from and after the date of this
Ordinance to park any automobile, truck or any other vehicle
whatsoever on any highway or street within the city limits of the
said City of Albertville, between the hours of 2:00 A.M. and 6:00
A.M. This parking regulation shall be in effect between the
dates of November 1st and April 1st of each calendar year.
2. It shall be unlawful to park at any time on the alleyway
lying and being on the East side of the old Catholic Church
property and on the public school walkway, lying on the West side
of County Road 35.
3. Persons or parties violating this Ordinance shall be
guilty of a petty misdemeanor and shall be subject to a fine of
not more than $100.00.

ORDINANCE 1986-4
AN ORDINANCE REGULATING
WIEGHT LIMITATIONS WITHIN THE
CITY OF ALBERTVILLE, MINNESOTA
The City Council of the City of Albertville does hereby ordain:
SECTION 1 MAXIMUM AXLE LOAD --GENERAL
Unless otherwise provided for in this article, the load limit
per axle on all city -controlled streets shall be five (5) tons.
SECTION 2 PERMITS: APPLICATION, ISSUANCE AND REVOCATION
A) Persons exceeding the weight limitations set forth herein
because of circumstances beyond control shall be required
to make application to the City on such forms designated
by the City.
B) Each application so recieved by the City shall be presented
to the City Council at its next re gular meeting and the
Council may act on such application at such or any subsequent
meeting.
C) Permits so granted may be suspended or revoke for violation
of this Ordinance and the owner or driver of any vehicle
driven on any city street in the City in violation of the
provisions of this Ordinance shall be liable to the City for
all damages s stained as a result of such illegal operation.
SECTION 3 SEASONAL LOAD RESTRICTION --SCHEDULE
There shall be in effect for the period between March twentieth (20) and
May fifteenth (15) of each year a load limit per axle of four (4)
tons on all city -controlled streets.
SECTION 4 SEASONAL LOAD RESTRICTION --MODIFICATION BY RESOLUTION
The Council reserves the right to change annually by resolution
the March twentieth (20) and May fifteenth (15) dates used herein
if road conditions so warrant.
SECTION 5 NEW STREEETS
No vehicles having a gross weight in excess of 75a of the limitations
provided herein shall operate upon any street within the City which
is in the development phase (gravel only) and for one (1) year
after the street has been surfaced with bituminous material.

SECTION 6 NOTICE OF RESTRICTIONS
The City shall erect or cause to be erected and maintained on main
streets of entry into the City, signs plainly indicating the
prohibitations of restrictions of this Ordinance.
SECTION 7 APPLICABILITY OF STATE LAW
A) The provisions of this Ordinacne shall apply in addition to
all County restrictions and Minnesota Statutes, Chapter 168,
169 and 171, as amended, herein above adopted by reference.
B) Liability for damages and penalties shall be in accordance with
Minnesota Statutes Sections 169.88 and 169.89, as amended.
