COUNCIL MINUTES
OCTOBER 20, 1986
The regular meeting of the Albertville City Council was called to order
by Mayor Walsh. Members present included Gary Schwenzfeier, Donatus
Vetsch, Don Cornelius and Bob Braun. Others present included Maureen
Andrews, Barry Johnson, Ken Lindsay and Gary Meyer; while Don Berning
was absent.
The following motions were made to approve minutes:
* August 27th Special Council meeting --the motion was made by Gary
Schwenzfeier and seconded by Don Cornelius. All were in favor and
the motion carried.
* October 6th regular Council meeting --the motion was made by
Gary Schwenzfeier and seconded by Bob Braun. All were in favor and
the motion carried.
* October 14th Assessment Hearing --the motion was made by Donatus Vetsch
and seconded by Don Cornelius. All were in favor.
* October 14th Public Hearing on Gary Vetsch variance --the motion was made
by Don Cornelius and seconded by Donatus Vetsch. All were in favor.
There was an application for a limited liquor license for the Floyd Roden
Fund Raiser to be held November 22 at the Parish Center. There was a
motion to approve the license and forego the $25.00 fee charged for the
license. The motion was made by Donatus Vetsch and seconded by Gary
schwenzfeier. All were in favor and the license was approved.
The following Building Permits were approved on the following motions:
Permit #56: 5178 Lannon Avenue for Barthel Construciton -- New Home.
The motion was made by Bob Braun and seconded by Don Cornelius. All
were in favor and the motion carried.
Permit #57: 11812 LaSalle Circle for Barthel Construction -- New Home.
The motion was made by Don Cornelius and seconded by Donatus Vetsch to
approve the permit pending payment. All were in favor and the motion carried.
Permit #58: 11806 LaSalle Circle for Barthel Construciton -- New Home.
The motion was made by Gary Schwenzfeie'r and seconded by Don Cornelius to
approve the permit pending payment. All were in favor.

Permit #59: 11649 51st Street for Doug Psyk -- New Home.
The motion was made by Donatus Vetsch and seconded by Don Cornlius. All were
in favor and the motion carried.
The Council reviewed the letter sent by KEn Barthel regarding the assessment
payment of the properties in Barthel Residential --Phase II, Barthel Manor,
Barthel Maple hills and the Industrial Park. The letter was requested by
the City for the residents in an effort to clearify who would be required
to pay the assessments. No action was needed.
Ken Lindsay was present at the meeting and asked if there was any thing that
could be done on 60th Street before winter set in. It was decided that
Maureen should contact Wayne Fingleson, Wright County Engineer to see
if the Councy would share in the expense of providing signs for the
lot. In addition Maureen was asked to contact the MN/DOT to see if
there are any funds available to make that area into a Park and Ride lot.
The motion was made by Gary Schwenzfeier and seconded by Bob Braun. All
were in favor.
Ken next updated the Council on the lst water transfer from Cell 1 to Cell 3.
He informed the Council that the the system is working extermly well.
Some final wrap up items Ken talked about was the sewer line cleaning. He
explained that the job went well and that the lines were in good shape.
he said that it helps that the school is using the degreaser in their
system.
Barry Johnson updated the Council on the driveway problem on Lannon Avenue.
(Jim Elfstrom's property) He told the Council that he was working with
Barthel and believed that they had the problem settled. No action was
taken.
Barry next updated the Council on the Construction projects. They planned
on Blacktopping Barthel Residential --Phase II starting Tuesday the 21st
in the moring. Curb and gutter was just about completed in Beaudry's
2nd Addition and the firm would be doing 52nd Street on the 21st. Barry
hoped that if the weather held that Beaudry's could be blacktopped
by Monday the 27th. Work in Psyk's 4th Additon had been started. All sub -
cuts are done and sewer and water has been started.
Jim Walsh commended Barry on his outstanding job of engineering that he has
been preforming in Albertville this summer. With weather and one than
one project going at one time Barry was kept on top of things.
Eugene Valerius asked if someone could come out and look at the green
Fire Truck.
There was a motion to pay bills. The motion was made by Gary Schwenzfeier
and seconded by Don Cornelius to approve check # .J27_ to # _qSU,,
All were in favor. The Meiny's Diggers bill should be paid but if rry_
Ba
can include that in the charges against the impeler problem he should do so.
Gary Meyer updated the Council on the prepayment of the Temporary Contruction
Bond. He explained to the Council that there was a problem with timing
and that there would need to be a waiver of the 30 day notice. He requested
permission from the Council to send a waiver out to the bond holders
asking them to waive the 30 day notice. The motion to proceed was made by
Gary Schwenzfeier and seconded by Don Cornelius. All were in favor.
The was a motion to continue the meeting at the Otesgo Town Hall in order
for the Council to discuss the fire contract with the Town Board members.
The Town Board reviewed the information sent to then by the City Administrator.
The Council and the Board then discussed how the figures were arrived at.
It was explained that we took actual 1985 expenses by the number of calls.
After a limited discussion the Town Board accepted the contract charge set
up by the Council.
There was a motion to adjourn at 8:45. The motion was made by Gary
Schwenzfeier and seconded by Don Cornlius. All were in favor.

ASSESSMENT HEARING
FOR
BARTHEL MANOR AND BARTHEL INDUSTRIAL PARK
The assessment hearing for Barthel Manor was reconvened by Mayor Walsh.
Members present included Donatus Vetsch, Don Cornelius and Bob Braun.
Others present included Maureen Andrews and Barry Johnson. Absent were
Council Member Gary Schwenzfeier and City Clerk Don Berning.
Barry Johnson of Meyer-Rohlin reviewed the assessment roles for Barthel
Manor for those present. The reason the hearing had been continued was
that there was some questions regarding 1979 assessment and the impact
of having the land replatted. Maureen informed the Council that in
checking with the County has found out what needs to be done to correct
the existing assessments on the books at the Courthouse.
The records should show that Mr. Ken Barthel of Barthel Construction
was the only person present for the hearing.
After limited discussion there was a motion made bu Don Cornelius and
seconded by Bob Braun to adopt the assessment role . The interest
rate is 8°0 over a 12 year payback. All were in favor and the assessment
was set. Maureen was requested to forward the information to the
County Auditor's Office.
The assessment hearing for Barthel Manor was adjourned.
The assessment heraing for Barthel Industrial Park (1985-1) was called
to Oder by Mayor Walsh. Notice of the hearing was read by Maureen Andrews.
Barry Johnson went through the assessment roles showing how the assessements
had been figured. He explained that it was Meyer-Rohlin's recommendation
that the residential properties abutting the Industrial Drive be assessed
under the same policy that the City has used in setting other residential
assessments, that is 100a for those lots abutting the street, 50" for
those lots whose side yard abutt the street. But because the Industrial
side of the street was figured by using the number on acres it was the
Engineers recommendation to use an average residential lot assessment
(figured from the other projects this year.)
Barry went on to explain that the reasoning for assessing the lots in
Barthel manor and Barthel Maple Hills is that when Barthel Industrial
Drive was put in those lots were then classified for industrial and
multiple dwelling use and that an additional burden would be put on the
industrial zone land if the assessment was put all on those effected
properties.

Barry had given each of the Council members a copy of his worksheets
(included as part of these minutes) so that they could follow along
with how he had figured the assessments.
After a lengthy discussion it was decided that the assessment on the
residential lots would be unfairly assessed because of the fact that
the lots in question will be assessed 1001,10' for future improvements when
the street, curb and gutter was installed on the front side of the
lots.
There was a motion made by Don Cornelius and seconded by Donatus Vetsch

Interest Rates were set for 10.250' for 12 years for all lots other than
Lot 99 Block 2--owned by Howard Larson and Lot 3, Block 10--owned by
Albertville Industrial Development Co for which the Interest Rate were
set for 8 over a 12 year payback.
The m otion was approved with all members in farvor of its adoption.
The assessment hearing was closed.
Ken Barthel some concern that Barthel Construction had been informed that
no building permits would be issued until the Monday October 20th Council
meeting because proper bridging over the new curb and gutter was not taking
place and damage had been done to the curb. It was finally agreed that
if Barthel Construction did proper bridging that was approved by the Engineer
that they could continue to work out in Barthel Residential --Phase II.
No action was required.
There was a motion to adjourn madeDonatus Vetsch and seconded by Bob Braun.
All were in favor and the meeting was adjourned.
TO WHOM IT MAY CONCERN:
Notice is hereby given that the City Council of Albertville, Minnesota will
meet at 7:3Z) p.m. on October 14, 1986 at City Hall to pass upon proposed
assessments for the improvements of Streets, Curb and Gutter within the
following areas:
Barthel Industrial Park
Barthel Industrial Drive
53rd Street N.E.
All benefited abutting properties are proposed to be assessed. The proposed
assessment is on file for public inspection at the of office of the City
Clerk and the City Administrator. Written or oral objections will be
considered at the meeting.
An owner may appeal an assessment to district court pursuant to Minnesota
Statutes Section 429.081 by serving notice of appeal upon the Mayor or
Clerk of the city within 30 days after the adoption of the assessment
and filing such notice with district court within ten days after service
upon the Mayor or Clerk; however, no appeal may be taken as to the amount
of shy individual assessment unless a written objection signed by the
affected property owner is filled with the City Clerk prior to the asses9ment
hearing or presented to the presiding officer at the hearing.

FOR
GARY VETSCH
OCTOBER 14, 1986
The public hearing for Gary Vetsch's application for variance was called
to order by Mayor Walsh. Members present included Donatus Vetsch, Bob
Braun and Don Cornelius while Council Member Gary Schwenzfeier was absent.
Others present included Maureen Andrews and Barry Johnson. Don Berning
was absent.
Maureen was requested to read the notice. The record is to show that
Mr. Vetsch was the only person present for the hearing, and the Council
was informed that notices had been sent to all property owners within
300 feet of the property.
The Council had already been made aware of Vetsch's problem, that is
the the northeast corner of the house he is building is 33.5 feet from
the property line instead of the required 35 feet and that the Building
Inspector had Red Tagged the construction.
It was agreed that to make the property owner remove all the work already
done on the lot would cause undue hardship. It was decision of the Council
to grant the variance of approximately lZ feet.
The motion to grant the variance was made by Donatus Vetsch and second by
Don Cornelius. All were in favor and the motion was carried.
There was no other related business so the public hearing was closed.
TO WHOM IT MAY CONCERN:
PLEASE TAKE NOTICE, that a public hearing will be held by the Albertville
City Council on October 14, 1986 at 7:00 p.m. at City Hall to consider
Gary Vetsch's application for variance of the following described property:
11561 55th Street, Albertville, Minnesota. Description of variance:
To allow for a 33.5' front setbackinstead of 35' as called for in the
City Ordinance.
At said time and place the City Council shall give all parties who appear
an opportunity to express their views with respect to the proposal.
