2015-09-30 CC Special Meeting Agenda Packet Council Special Meeting Agenda Wednesday, September 30, 2015 Fire Hall 6:00 p.m. 1.Call to Order 2.Westside Liquor License (Motion to approve an Off-Sale Liquor License for Robert and Linda Feuling for Westside st Liquor, located at 11095 61 Street NE, Suite P.) 3.Adjournment Agenda Page 1 Mayor and Council Request for Action September 30, 2015 SUBJECT: WLL ESTSIDE IQUOR ICENSE RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following: MOTION TO: Approve an Off-Sale Liquor License for Robert and Linda Feuling for Westside st Liquor, located at 11095 61Street NE, contingent upon receipt of successful results of background checks. BACKGROUND: Westside Liquor is in the process of transferring ownership. Westide Liquor is currently licensed under S & D Liquors. The City Code requires that a new liquor application be completed by the new owners/applicants. A liquor license cannot be transferred from one owner to another. In order to avoid disruption in business at Westside Liquor, the applicants have requested a special meeting of the City Council to approve their liquor license application. KEY ISSUES: The applicants have paid the appropriate fee for the license. The City Code requires that the fee be pro-rated for the remainder of the license year (current – April 14, 2016). The applicants are seeking approval of the liquor license at a special meeting in order to avoid disruption of business sales. After City Council approval, the license must also be approved and certified by the MN Alcohol and Gambling Enforcement Division (MN AGED). The applicants must have background checks completed by the MN Bureau of Criminal Apprehension and the Wright County Sheriff’s Office. These checks cannot be completed before the special meeting and before submittal to the MN AGED. MN AGED is willing to process the application and issue the license with the understanding that if any unsuitable background checks return, they will be notified by the Cityand they will revoke the license. Proof of Liquor Liability Insurance has been submitted. POLICY/PRACTICESCONSIDERATIONS: The Mayor and City Council have the authority to either approve or deny an application for a liquor license. FINANCIAL CONSIDERATIONS: The fee for this liquor license is pro-rateddue to a partial year license and is nominal. Responsible Person/Department: Kimberly A.
